hi.

i,m a bit confused myself. just received ESA50 to be returned to ATOS.

I also had medical and tribunal nearly 3 years ago and was awarded benefits.
I also receive dla.
why do we have to fill this form in again, and why is it being sent to ATOS.

Hi jtes,

Welcome to B&W,

All the information that you need should be contained in my original post to the O.P., here :

Being in receipt of DLA gives no exemption to being migrated to ESA, even if you were previously PCA exempt.

All Incapacity Benefit, (IB) Income Support (IS) due to incapacity, and SDA recipients are being transferred over to ESA anytime upto Spring 2014.

Have a look at our : IB, IS, SDA, Migration to ESA FAQ’s and "Being transferred from incapacity benefit to employment and support allowance" which is the first link on this page : ESA Claims Guides

Can you please start your own new topic in future, to avoid confusion.

Hi jtes,

I have created a new topic for you "ESA50 Form 2", can you please post on this, from now on.

There are no indefinate awards with regards to ESA, see : How often will I be reviewed

Here is a link to my post on the other topic for your reference :

Hi J,

Even though it appears that you have been in receipt of ESA since 2009, and are not being transferred over from IB, IS or SDA, there are still no indefinate awards, you can expect to be reassessed at regular intervals. The 3 years that you have just had, is the maximum length of an award, before reassessment that we are aware of, see : How often will I be reviewed
