Hello all

i recently went through the appeals procedure and had tons of advice from B&W forum for which i'm very grateful. Thank you again. And now my friend has just received a decision letter ESA65 (09/12) saying she's been found fit for work, so now she's going to begin her appeal. I'm helping her with the letter of intent to appeal to SSA, but i'm not sure if i can add that she wishes to apply to continue having her benefits paid at the phase rate until her appeal is heard. Can we add this or have things changed in this respect?

The ESA Assessment rate is still payable when appealing a Fit for Work Decision, so there is no harm in mentioning this.

If you are writing a letter of Appeal, as opposed to completing a GL24, then you must make it clear that you are requesting an appeal and provide all of the information normally required on a GL24, if you do not, then you run the risk of the appeal being returned as incomplete.
