is this unusal was created by carol56
A friend had her medical in July 2012 and had no communication from dwp at all then yesterday a phone call to say she had received 12 points so therefor fit for work and her last payment would be 27th Feb she is understandably devastated and will appeal but cannot understand the long delay in finding out any views regards x

Hi c56,

That is an awfully long time after a face to face to receive a fit for work or any other decision, circa 7 months !!!!

Your friend might want to raise this issue with The DWP, are the recommendations made by The ATOS HCP 7 months ago, still pertinent ?

A Decision Notice letter should be sent to your friend, (they must inform them in writing) they will then have one month from the date of this letter to submit an appeal using GL24, which can be downloaded from the link on this page :

Your friend may also wish to request a copy of The ESA85 medical report, see :

ESA Forms

There will also be an LT54 form.

They can request this by ringing the Benefits Office that is dealing with their ESA, we recommend that this verbal request is backed up with a written one.

Thank you for your reply spoke on the phone and she has received a letter today with a simple explanation as to why she scored 12 points but nothing about how to appeal will be helping with her appeal regads C xxxxxxxxxxxxx

Hi c56,

Just to remind you that if your friend wishes to be paid the Assessment Rate of ESA whilst appealing, then they will also have to obtain a fit note (Med 3) from their G.P. to cover them from the date of the fit for work decision, and submit this to the DWP, as well as submitting the GL24 :

What will I be paid while I appeal?

Hi thanks again for advise can you tell me if you claim the assessment rate of esa while waiting to appeal and you where to lose the appeal do you have to repay said money regards C xxx

No, there is no requirement for you to repay anything you have received while waiting for a Tribunal hearing.
