It was disregarded by the DWP because it was in payment before 2001 in actual fact it was in payment late 1999.
So I still do not know what to do for the best, however I think I might have a Benefits Advisor phoning from the CAB.

The disregard applies to Contribution Based ESA, but not to Income Related ESA, which is why you need to get advice before proceeding.
