Re-applying for ESA? was created by Debs424
Is it possible to re-apply for ESA, in the hope of being placed in the support group, if you are already in the WRAG group or do you have to wait until your WRAG is completed?

Hi T,
You can appeal a WRAG decision within one month of receiving the Decision Notice letter. If the one month deadline has passed, you can make a late appeal up to 13 months after the date of The Decision Notice.
You must show good cause for a late appeal, and only The Tribunal can decide on whether this will be allowed, they have been looking favourably on late appeals recently.
This is covered in The GL24 form which can be downloaded from the link on this page :
How to submit an appeal
In either of the above scenarios, it would be looked at on whether you should have been placed into The SG at the time of the original WRAG decision, and will not take into account how you have been since then.
If you feel that your medical condition has deteriorated, or you now suffer from new medical conditions to such an extent that you may now qualify for The SG, you can request a supersession/review of your existing WRAG award.
You do not have to make a fresh claim to do this.
You could request a review by writing a letter, or by using the GL24, (if GL24 make it clear that you are requesting a supersession/review, and not an appeal)
You would need to provide medical evidence, and it would involve filling in a new ESA50 etc.
As with an appeal there would always be some risk involved to your existing ESA award, in that it would be looked at anew.
