DLA migration

I already receive (indefinitely) DLA middle rate care and lower rate mobility, and I know that the government has postponed until 2015 the migration of DLA recipients before they are reassessed for PIP for those who are receiving DLA indefinitely. I am considering asking in my lower rate mobility can be looked at again as my condition has become considerably worse since I was first awarded it. The question I'm asking is with PIP coming into force in April if my form is not received by them until after the new regulations come into force will this bring my migration forward from 2015 to April 2013?. If this is the case that I will be reassessed under the new PIP criteria. It doesn't seem as though it's worth asking for my DLA to be looked at again because I can walk more than 20 m but less than 50 m, so even though my condition is becoming worse by asking them to look at it again. I could possibly lose what I already do get or it will be no more.

Hi B,
There is always some risk involved when requesting a review of an existing DLA award due to a change in your circumstances, such as a deterioration in your health.
However if you request a review of your current indefinite award before October 2013, you should be reviewed under DLA criteria and not PIP.
As far as I am aware Lower Rate Mobility is awarded for mental health limitations and not walking limitations, and the 20 meters that you mention is PIP criteria and not DLA.

Reassessment for PIP of fixed period DLA awards coming up for renewal, young people turning 16 and where DLA claimants with indefinite awards report a change in their condition."
You can request that they only re-look at your Mobility Component, but they can re-look at both components.

I was awarded lower rate mobility in 2000 when I was registered blind by my ophthalmologist. I have a condition known as RP which means I have a very small window of central sight, I was reassessed in 2011 and the decision maker decided that I do not qualify for the higher rate of mobility at the time. I asked them to look at the decision again but I never got a reply. The reason I'm considering asking them to look at my mobility rate again his because I have COPD and in combination with having to use a white cane while walking and having a oxygen cylinder on my back to help with my breathing. I cannot walk more than 50 m without becoming unsafe on my feet.

With respect to COPD, you could gain copies of any Spyrometry Tests that you may have had at your G.P.'s practice, which should include your Peak Flow, and "Lung Age", and what severity of COPD you suffer.
You may have also been assessed on The MRC Breathlessness Scale, this is graded 1 to 5, 5 being the most severe.
Copies of all the above, can be very useful supporting evidence.
