hi all .my brother who is 61 has just moved into sheltered housing ,he attended a wrag interview and was asked how his atos medical a few days back had went.brother was quite shocked to hear this as he knew nothing about it.the guy who was doing the interveiw phoned atos and explained that my brother had just moved house and had no idea he was supposed to have a medical.now just received a letter from atos saying that this was no excuse and his money has been stopped.so i take it he will have to get a gl24 and appeal ,will his money be reinstated if he appeals till appeal is heard ....... many thanks

Are you sure the letter was from ATOS and not the DWP as Atos have no authority to make Decisions in regard to benefits?

On the assumption that this is from the DWP, then yes, he needs to lodge an appeal, did he notify the DWP and ATOS in advance of his change of address, he will need to show that the letter in regard to the appointment was posted to the wrong address despite his contacting the DWP and ATOS.

I am afraid as this is a technical failure, he will not be entitled to payment unless the Decision is overturned or he attends an assessment.

He can make a new claim for ESA, but still will not be paid until he has attended an assessment or six months have elapsed, whichever is sooner.
