CB ESA about to end advice needed please was created by Pedropete
I've just received a letter informing me CB ESA is to end in May. I was expecting this but thought they would ask for information to see if I would be entitled to IR ESA (which I would). They mention nothing just that they cannot pay me from May.

My questions are how do I go about getting onto IR ESA? Is there a form for this or something? If there is would I be able to get it from my local CAB as I'd rather not speak to Jobcentre Plus on the phone.

And finally would I have to go through the assessment/appeal process again or would my current award continue as I can't face going through all that again although I know I will have to at some point.

The DWP should contact you before your payments stop with an ESA3 form, which is ued to capture details of your finances, which they will require in order to check your eligibility for ESA(IR).

The CAB may have this form, if not, then you may be able to get one from your local JC+ office.

Being switched to ESA(IR) should not result in your being re-assessed for ESA, but you will be re-assessed at some time in the future, have you requested your ESA85, the prognosis is usually used to set when this will be done? You can request this from the DWP office that deals with your claim.

Hi Pp,

You can request that you should be assessed to see whether you pass the "Means Test" with respect to being entitled to IR ESA.

This is generally done by the way of filling in an ESA3 Form, which purely assesses your financial situation, and has nothing to do with The ESA WCA, and which "Group" you are in. (WRAG or SG)

You could write to The DWP and request an ESA3, see :

Thanks for the advice.

My ESA is due to end on 24 May. How long do you think I can leave it until it looks like I won't be sent the form as ideally I'd rather get it through the post rather than go to CAB or am I better just dealing with it and applying the sooner the better?

And you mention asking for form ESA85 to find out when I'm likely to be re-assessed. I won my award on appeal at a tribunal and it said I shouldn't be re-assessed for 18 months. Isn't this a good guide or do they just ignore it?

Hi Pp,

The DWP did state that they would be inviting claimants to apply for IR ESA 8 weeks before their payments of CB ESA were due to end.

Therefore, it "should" be in the next week or so.

With respect to The Tribunal's recommendation of when you should be reassessed, I afraid that it is only a recommendation, and has no legal standing.

We have had feedback regarding this from two different members in recent days.
