IB Migration have not received ESA50 yet.

Does anyone know if you can migrate from IB (1993 btw) to ESA without a form ESA50. Had the letter and follow up phone call early January but nothing since. Don't particularly want to cantact them and understand that if the form had gone missing, I would have received a 'kindly' reminder that it was outstanding:(

Highly unlikely, I would expect to receive an ESA50.

I can understand why you don't wish to contact ATOS to see where the ESA50 is.

However, it may be in your own interests to do so.

If the ESA50 has got lost in the post, the reminder letter may have as well.

Further, even if you did receive the reminder, and no ESA50 previous to this, you would only have one week to obtain an ESA50, fill it in, and return it.

There is case law that makes the assumption that if ATOS can prove through their systems that they posted out the ESA50 etc, then it will be assumed that you received it, even if you didn't. This can be very hard to challenge.

As you have received the Conversion Notice and the phone call, your migration has definitely started.

I would advise that you contact ATOS by e-mail :

Informing them that you have not received your ESA50 Questionnaire, this will create a paper trail. I would also send a hard copy of the e-mail to the Benefits Office dealing with your Benefits :

Sending Documents to the DWP or ATOS

If the ESA50 has gone missing, and is not returned by the deadline given, it will be assumed that you have failed to return it, and your file will be returned to The DWP, which may result in the loss of your benefit.
