Hi Forum
I am currently awaiting an appeal reconsideration from WRAG (CB) to hopefully SG, I have this questions that I am not sure about.

Q1. I was placed into WRAG late December 2012 so my 365 days are ticking down, if I were lucky enough to be placed in the SG for a period of time am I correct in thinking that my 365 day clock stops but is held at whatever days I have used in WRAG ?

Q2. What would happen if at a later date I were put back into the WRAG would the 365 day clock carry on from where it stoped prior to being in the SG ? say if I used 100 days in WRAG, would it restart at day 101 ?

Q3. If I have a mixture of WRAG (CB) and then into SG (CB) during the 365 day period are they lighty to switch me to SG (IR) at the end of 365 days in total ? providing I can satisfy the SG criateria in order to stay within the SG.

Q4. As my WRAG is (CB) which stops after 365 days would the same apply if I were in the SG (CB) for 365 days and be put on SG (IR) if I qualify.
Is there any time limit or point where the SG (CB) becomes SG (IR) as in WRAG ?

No, as an appeal re-makes the original Decision it also applies from the original date, so assuming you win your appeal you wil be placed in the SG from 12/12.

Forgive me, I cannot look at your older posts to check, but if this was your first time on ESA then the clock will be reset to zero, if you were in the WRAG prior to the 12/12 Decision, then it will be stopped.

If this was your first award of ESA then you will start from zero, if not then it will proceed as you have illustrated.

There would be no need for the DWP to switch you to ESA(IR) if you are in the SG, because you would remain eligible for ESA(CB) payments, even if you have previously exhausted your 365 days in the WRAG.

However, it may be too your advantage to check if you would be eligible for an ESA(IR) top-up, as it may result in increased payments and access to other benefits.

Time in the SG does not count against the 365 time limit.

Thanks for making it a whole lot clearer with the detailed info's.

Yes, its my first time on ESA having been migrated from IB, I have been in the WRAG since December 2012 this is my first time on ESA, this seems to be important as if I get SG then those days used while on WRAG are wipped out and it then appears as if I have been on SG from the start of my ESA claim is this correct ?

Yes, having been transferred from IB, if you were to win your appeal and were placed in the SG, then it will be as if you were never in the WRAG and the count remains at zero.
