ESA WRAG to support but no extra and no backdated

Hi all
As I have said earlier I successfully appealed the ESA WRAG to Support with a reconsideration.
Initially Migrated from IB to ESA.
After waiting 7 weeks and no backdated money appearing into my account,
I rang DWP ESA Department today and received a call back.
I have been informed that I will not be getting any backdated ESA or even any extra ESA allowance for being in the support group,
As I have been paid ESA at the IB rate to protect my allowance.
Is this correct it seems very strange.

Hi fg,

It is possible, if your IB and any associated IS, etc, was more than you would have received on ESA, then you would have received the same amount when transferred to ESA under Transitional Protection.

So the crux of the matter is, would the amount that you would have received if originally placed into The SG have been more than the amount paid under Transitional Protection, if yes, then they would owe you the difference, if no, then they wouldn't owe you any back payment.

Thanks bro58 very informative as ever I will take a look at the FAQ
I have been informed today I may be able to claim INCOME RELATED ESA,
But I will have to work out my applicable amount.
Have now lost all income related benefits.
We all need an accountant to work out benefits nowadays. :laugh:

Yep, I know what you mean :laugh:

They should ask you to fill in an ESA3 Form to assess your financial situation.

As you probably know, there is no 365 day limit to payment of ESA in The SG whether it is IR ESA or CB ESA or a combination of both, just as there is no such limit to payment of ESA if any part of it is IR ESA no matter which group you may be in.

As this SG award is a remaking of The WRAG award, it will be as if you have never been in The WRAG, therefore if you are not entitled to IR ESA, and are put into The WRAG at some future reassessment, you will still have your full 365 days entitlement to CB ESA in The WRAG.

Its just a pity that the Transitional Protection does not apply to protecting the clients who have lost out big time, When losing all income related benefits such as cold weather payments.
So much for the con/dems Mantra no one will loss out after the transfer from IB to ESA.
