I've just sent my WCA form to Atos as I'm currently on IB and presume I will receive a date for a medical and be found fit to work soon.

I have two queries. I am finding it hard to get supporting information from my GP and former hospital consultant. I say former consultant because after four bouts of cancer in 12 years, I finally reached my five years cancer free in August last year. After that the consultant said he didn't need to see me again. I feel this weakens my case and he has yet to respond to my request for support. My GP likewise is fed up with being bombarded with requests for support for these computer programmed 'assessments'. What can I do? I can't really afford to pay for a medical report but I suppose that's what I'm going to have to do :(

I thoroughly expect to be found fit even though I have other disabilities caused by my treatment for cancer and hospital acquired diseases. Will they just stop my money straight away? They are also paying the interest on my mortgage so I'm going to assume they will stop paying that as well?

I don't really understand WRAG. If in the unlikely even I'm am placed in that, does that mean my mortgage will still be paid? How much do you get in WRAG and is it only for one year?

Sorry I know these are dumb questions.

I also complained to the DWP and Atos as they failed to send a covering letter informing me of when my form was due back (if I hadn't have realised from here there is only a 4 week turnaround I would have missed it) - I felt that it was a ploy to ensure that I missed the date and gives them a reason to stop my money. The DWP took a phone complaint and some snotty woman phoned me back with a very insincere sorry. I was told I could have extra time to complete the form as I can't write, so have to get someone to fill the form in for me and as you can guess, that takes time. The one week reminder letter arrived with the original return date so I've written to DWP, Atos and MP and complained that I was given an extension or was this again another ploy to make me think I'd got extra time when I hadn't, to ensure I missed my return date. I know it was probably a computer generated letter, but I feel the need to complain at every turn with these people although that probably gives them a reason to find me fit!

This whole thing is raising my blood pressure to the extent that I was almost admitted to hospital last week for hypertension (I take medication for high blood pressure).

To try and answer your questions.

If you think you need up to date evidence, then I am afraid this may mean you will have to pay for it, unfortunately, neither your GP or Consultants have any obligation to provide you support in regard to a benefit claim, even if an offer of payment is made.

As an alternative you cold try requesting a copy of your medical records, whilst the content is dependant on when you last received an update from your Consultants it may none the less provide the information you need. See

The important thing to remember with regard to ESA is that it is not the condition(s) that is considered but the effect it/they have on your daily activities in respect to the ESA Descriptors, see our ESA Claim guides for a more detailed explanation.

If you are found Fit for Work, then you should receive one further payment of your IB before payments stop, this would include any mortgage assistance you are receiving.

If you are receiving mortgage assistance, then I would think that in addition to your IB you area also receiving an Income Support top-up, this being the case, then when you are transferred to ESA you will receive Contribution Based ESA with an Income Related ESA top-up , the ESA(IR) will enable your mortgage assistance to continue.

If you are placed in the WRAG, then your ESA(CB) payments will only be payable for 365 days after which they will cease, however, if you are also receiving ESA(IR), then your payments will continue without interruption and will not be time limited.

With regard an extension and your complaint, there is no legal framework in the ESA legislation to allow for an extension of the four week completion period, so it is entirely at the discretion of the DWP to allow such an extension, however, I have to warn you that unless you have the extension confirmed in writing, it may not be worth anything unless your phone conversation was recorded and you are able to gain access to a copy of it.

It is also important for you to note that this part of the transfer process is managed by ATOS, so unless the DWP have notified them of the extension, they will continue operate to the original deadline, as evidenced by the standard letter issued at three weeks.

I would recommend, that you contact ATOS and explain that you have been granted an extension, I would email them so there is a "paper" trail and, if you are unable to submit the ESA50 on the original deadline, to include a covering letter when you do, detailing what has happened and that the DWP have granted you an extension.
