Do the DWP always do an EMP report for DLA? I ask because I didn't get one when I received my SAR.

The DWP are not required to hold an assessment if they believe that they already have sufficient, relevant medical evidence to make a Decision, however, their failing to do so, would be relevant to any appeal against a failure to award or to award an appropriate level of DLA.
Did you ask for all documents or just the medical report, they may be using old report or one for ESA?

Thanks for replying Gordon. Unfortunately I have received my renewal DLA pack and I am just going over my previous stuff and reading the stuff on this site when I noticed it mentioned the EMp report. I requested a SAR for both ESA and DLA at the time (end of 2011) but had never heard of the EMP until today, so I checked and I didn't receive an EMP. I didn't get a medical for DLA but I got one for ESA around 6-8 weeks prior to that. The award for DLA was based on - "your claim form and the extra information you gave us". What was the 'extra' info I gave them???? I only sent in the form as far I as can remember?

Sorry I forgot to ask - with regards to the claim form, is there a way I can 'type' my answers on the claim form? You gave me the link for the form a few weeks ago and I clicked on it but I can only 'read' it, I can't 'write' on it too. I just want to use it as a 'practice' for the time being if it's possible, failing that I will just print it out and write on it.

Hi mg,
EMP = Examining Medical Practitioner.
So what Gordon is saying is that if you didn't have a DLA "Medical", there may not be an EMP Report.
The DLA DM may simply have used your DLA Claim Form + added evidence, and your ESA Medical Report in coming to a decision.

I have not tried the forms but there are two links, one is to a form that you print and write on, the other, as I understand, allows you to input your answers on to it. It needs to be saved to your PC first and based on other DWP forms, the space allowed may well be insufficient for the amount of text you want to put in, their usual practice is to reduce the size of the text if there is too much, of course you can continue on a separate sheet.
