Ill Health Pension was created by LIAO
Have been on IB(C) since 2004 when medically retired from work which was desk based and with a company who abided by the Disability Act. Went through all the tests and examinations required. Last September the company requested ATOS to confirm that I was still unfit for any kind of employment in keeping with terms and conditions. ATOS agreed that I am still unemployable and not to review my case for at least another 5 years. Seems to me I will be caught between a rock and a hard place. On one hand ATOS stating absolutely unable to work on physical grounds and on the other hand, highly likely that DWP's ATOS will at best place me in WRAG as I can just about put one foot in front of the other - going by what I read on here. What on earth will my pension provider think of this? Any advice please, or other people's experiences, will be much appreciated. I am also in receipt of DLA High Mobility and Low Care rates. Thank you.

The only thing I can say is that the criteria for your pension being paid are different from those to access ESA. Although ATOS were involved each time, they were merely administering the scheme according to its rules.

My pension provider doesn't ask whether I get ESA/DLA, does yours? If they do, then I suspect that they will already have met people in a similar situation to yourself.

In my opinion, your private retirement pension has nothing to do with the DWP, unless you claim a means-tested benefit.

My wife is a former staff nurse and due to contracting an Industrial Disease at work was retired by the NHS Pensions Scheme when she was 50 years of age and received her full NHS Pension.

She is now 64 years of age and receives her NHS Pension plus on reaching 60 has been paid full State Pension and is in receipt of DLA mobility and care.

As she's in the 16-64 age, she will in the future have to claim Personal Independence Payment (PIP) despite being in receipt of full State Pension and retired since 1992.

Confused !, join the club.

Sorry to correct you Jim, but in the interest of members having the correct information.

Both IB and ESA(CB) make deductions for personal pensions, although in both cases there is a disregard before deductions are made, the DWP are entitled to request this information from a claimant.

Yes G,

Unless previously disregarded as explained in Gordon's link, CB ESA has the same rules as IB.

The first £85/week of any OP is disregarded, then 50% of any excess is deducted from your weekly CB ESA.

e.g. £100/week OP,

£85 disregarded leaves excess of £15/week.

50% of £15 = £7.50/week deduction from your CB ESA.
