help WRAG was created by scoobster
hi guys i received a letter dated the 26/4 saying i was in the in WRAG do i appeal or ask for a revision also i have a doctors appoinment on the 9/5 to see if if i can get a doctors letter to say i cant work do i need to ask for info from dwp or or just send the gl24 in and go from there?

im at the end of my tether at the moment and dont know what to do i did use your guide to fill the forms in but it only got me through on DLA not income support.

please help

Hi s,

It is your choice on whether to appeal or request a reconsideration in the first instance.

If you appeal, you will receive an automatic reconsideration anyway. Only if the decision was not changed in your favour then, would it be sent forward to The Appeals TS.

A letter from your G.P. stating that you were unfit for work would probably not be that helpful. Being placed in The WRAG means that you are unfit for work, in that you have Limited Capability for Work (LCW)

To gain access to The SG,you also have to show that you have Limited Capability for Work Related Activity (LCWRA), which would obviously include WFI's etc.

The important issue, is to show how you qualify for The SG by fulfilling at least one of The SG Functional Descriptors :

sorry there was one thing i forgot to mention i claimed DLA at the same time as IS my DLA got an indefinate award yet i get WRAG for IS do you thinks if i phoned them as said i get the award for that it might works to my advantage as one is saying im sick and another is saying im fit to work at some time do thay have any idea what there doing at that place?? :)

my illnesss`s are (if it helps)

photosensitive epilipsy
incontenence (requiring pads)
asthma
psorisis (sorry cant spell)
and a few other smaller ones

DLA is an "In Work" benefit, i.e. you can work whilst in receipt of DLA.

It has differing qualifying criteria than ESA and is awarded due to your Mobility Limitations and/or your Care Needs.

ESA is an out of work benefit, (except for permitted work) and you are assessed on your capability for work and work related activity.

You could also request the documentation used in coming to the DLA award, and if there was anything positive and supportive within it, you could use it in evidence with your ESA appeal.

thanks bro i will phone them both tomorrow and see what they say and i forgot that you can claim dla while working, and another thing i forgot to mention i didnt have a medical.

one thing i dont quite understand does wrag mean i have to look for work like jsa? or am i still exempt like income support.

Hi s,

Just to reiterate, being placed into The WRAG does not mean that you are fit for work.

It is not your illness that may or may not qualify you for an award of DLA or ESA, (except for a few exceptions).

With DLA it is the walking limitations and/or care needs caused by your medical conditions.

With ESA, similarly it is the limitations as a result of your medical conditions. You must either score the minimum 15 points to gain access to The WRAG, or fulfill at least one of the SG Descriptors.
