Wca IB to ESA was created by Dee
Hi Guys
I am new to the Forum so first of all apologies for creating a new post if an old one would suffice.
I had a WCA at Romford Atos with an Occupational Therapist whom has completely distorted my health issues.
I have been on IB for 8years for severe psoriatic arthropathy and colitis as well as Sjogren.s Syndrome and Chronic Fatigue.
My illness was managed on Anti TNF therapy which stopped working last year and have got progressively worse as a result.
The condition pertaining to my psoriasis has been bad for eighteen months so I know the effectiveness of the drug was that I am non responsive.
I was put forward for a trial but failed to enrol due to abnormal blood tests results outside of the Drug company guidelines.
I attended the interview [phrase removed] with an Mckenzie friend, I was driven to the interview by a friend and he stopped outside the office and then waited for about fifteen mins before the HCA called me in.
I changed my seat at least twice as I was in discomfort due to the arthritis and went to the toilet at least twice due to my colitis.
During the interview I stated as I have on my ESA50 my health conditions, the interview lasted one and a half hours during which I moved seats four times as I had pain and cramp again due to my arthritis as now I do not have anything to control the condition.
What I do take is no longer working as it should, I informed the HCA that I suffered from depression due to my illness also that my condition varies in terms of severity.
My fatigue is so severe that on some days I cannot get out of bed without great effort.
On my better days I go to the gym to use the sauna and steam facilities.
Due to my colitis I can lose control of my bowels once a week to a few times a month though this can vary I am very careful about what I eat before I go out to limit this occurrence.
I took letters from my doctor to,the interview and submitted them to the HCA
I informed her that my depression has lead me to thoughts of suicide but had not acted upon them.
I am a qualified professional whom worked from the age of 15 until I was struck down and now in my late thirties I have been struggling with ill health.
I was asked to raise both arms could only raise one I could not bend to touch my feet.
I received a letter from the DM
It doesn't recognise my Psoriasis or Arthritis they have categorised it as Musculoskeletal problem Abdominal problem.
This is despite that I provided the HCP with medical letters detailing my conditions medications and what Investigations I have undergone.
DM alleges that I was observed to sit for 45 mind continuously [phrase removed] no mention is made of my moving seats four times in ninety minutes.
I was picked up and dropped off outside the Atos test centre.
I have been awarded 0 points.
I have not at any stage in my life been a malingerer I volunteer and help others when able to I get no pay as I am deemed to do this I am presumed to socialising though much of the work is done on computer and I use dragon dictate and touch screen adaptation.
Also because I have apparently not tried to commit suicide it is of no relevance that I am depressed.
The complete fabrication has shocked me I am aware of the tactics used by ATOS but Maggie has even surprised me by omitting crucial information she did not even recognise my illnesses.
My benefits are due to cease on the 18th of May 2013.

I notice that you have been a member for several months, although this is your first post, did you use our guides to complete the ESA50, when did you receive the ESA50, and do you know which version it was?
You have two options;
- you can make a new claim for ESA, however, you will only be able to do so if you can meet the means test for Income Related ESA, you will not qualify for Contribution Based ESA due to you NI Contribution history.
- you can appeal the Decision that found you Fit for Work. While you appeal you will receive ESA(CB) at the Assessment rate, currently £71.70 per week.
Our ESA Appeal guide explains the process in detail

You should also have a look at the following

If you have specific questions, please reply to this post.

Dee,
sorry to here you had such a terrible time.
I have a relative with psoriasis and the arthitis is crippling. I know the problems of Chronic Fatigue and Arthritus first hand!
Does your doctor realise the full extent and limitations of it enough to give the DWP assessor examples of your problems in graphic detail. ie, can you straighten your arms, grip a pen, etc. Also how painful is it to set up and use the computer for example?
I expect they have already done this but it might be worth repeating it as the ATOS individual does not appear to realise how your health problems affect you.
Too late for this, but they now agree to record interviews and give you a copy if you ask in advance.
If you reapply that is worth doing. I asked when I was sent my first interview date, now have 2 weeks more wait so no more info on that score yet.
Best wishes for the appeal/ new claim or whatever you decide.
