Good evening all

My husband is in the process of completing his ESA50.

With reference to question 1 Moving around and using steps. The distance he can actually move about is much less than the minimum 50mtrs as stated on the form. the DWP have said "don't tick any boxes and write a full explanation in the box provided" He is anxious that by not ticking any box may impact on the claim. Has anyone got any alternative suggestions or does the DWP advice seem reasonable?

Many thanks

Margaret

Hello Margaret,

We advise members to not tick the boxes if doing so would not give an accurate picture of the claimant's limitations. This is discussed in our ESA guide.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi M,

If you feel that none of the tick box options fit in with your hubby's limitations, you do not have to tick any of them.

Simply make a written comment such as "none of the tick box options are applicable, please see information below/on added page"

Make the ESA50 fit in with his limitations rather than the other way round.

Hi bro58

Thank you for the advice and quick response. We have sat pondering over this and hubby phoned DWP and was advised by a very helpful advisor not to tick any box. We did however feel we needed further confirmation on this.

I think your advice regarding making the ESA50 fit his limitations as opposed to the other way round is spot on! Here's hoping he remains in the support group where he is at present without further stress (won't hold my breath though)
