My assessment report says I was observed to be able to walk with a stick for 25 metres.

I don’t have a stick.

There are a few other inconsistencies. It says I will not take any medication for headaches. I said a long time ago a GP prescribed anti-depressants as a last resort for headaches, that they didn’t work, and I have been addicted to 2 different types of painkiller.

It says I have no loss of sensation and was observed to be able to sit for 45 minutes. I was in considerable pain throughout the assessment, and had got up very early so that I could walk and sit a little before the assessment.

I’m just starting my appeal, I’ve only just found this site. Any help would be appreciated.

Yes, you can certainly challenge any part of the ESA85 that you feel to be inaccurate. However, it is even more important to demonstrate how you meet the Support Group criteria and, if possible, provide evidence to back this up.

Qualifying for the Support Group

IN the first instance,the important thing is to get your GL24 appeal form submitted in time, then you can send additional information and evidence afterwards. A more senior decision-maker will look at your claim and reconsider it before it is sent to appeal and the ideal situation would be to get the original decision overturned at this stage if possible.
