ESA (CB) 365 days from when? was created by TemporallyLoopy
I changed from IB to ESA(CB) and following my recent medical have been put in WRAG (which I am appealing).

The ESA50 was sent out at the end of November 2012 but the medical was delayed until April because our local ATOS was busy(!), so the ESA award didn't start until 8th May 2013. I had originally assumed, and the DWP told me on the telephone, that my ESA(CB) would end on 27th November 2013 (the anniversary of ESA50 claim form being sent to me).

In a posting the other day, Gordon (I believe it was) mentioned that it should be 365 days from the date of the ESA award which began on 8th May 2013 which would make sense.

However, having checked the wording of the "your benefit is changing" letter it definitely tells me that the ESA will only be paid from 8th May to 27th November, unless I get into the Support Group. Therefore, they have definitely taken into account the period in which I was still on IB?

Is this correct or am I going mad?

Thanks.

No T Loops, you are not going mad(der)!

Your 365 days is counted from the day the ESA award began (up to that point you were still on IB and that has no time limit attatched). However, the DWP do like to cause confusion so they pop that November date onto the letters. It is a date that is used purely for DWP administration (possibly the day the Christmas bonus is allocated) and has no bearing on when your WRAG will cease being paid.

As an aside, we mods find it really helpful if members keep all queries in one thread/topic. Please can I ask you to do this in future by choosing one of your previous threads rather than starting a new thread/topic each time? You will find it easily in future if you bookmark, or make it a favourite, now :)
