ESA Appeal Question was created by emsher22
Hi I let you know a few months ago that I had usied the guides on your website and had been successful in getting my DLA High rate mobility and Low rate care renewed until April 2016. At the same time as completing my DLA forms I had to also complete the ESA50 for my migration from long term incapacity to ESA. I received their decision in March which placed me in the Work Group without having to attend a medical. I asked for a letter detaiiing what they had based their decision on and received an ESA85A and on the basis that they had based their decision on the evidence available to them my ESA50, Med 3 and 113??I am appealing. I have used your guides to completethe GL24 they received it on the 10 May. I have heard nothing since but I now have other evidence (copies of letters to my GP from consultants dating back several years) to submit but most importantly a letter from my GP saying that in her opinion I am not fit to work for the forseeable future. Do I submit the evidence now or do I wait to receive the appeal papers? I have had no contact with them by phone as I asked them to only write to me as I didnt want to discuss benefit matters over the phone as stated in your guide. I have also so far not been contacted either to attend my first work based interview . Thanks for all your help

As part of the appeal process a different decision maker will look at your claim and see if the same decision is reached. You aim should be to get the decision revised at this point, therefore you should submit your supporting evidence and information as sson as you can. There is no set time-frame for the reconsideration, it could take anything from a couple of weeks up to 6 months!
As you are in the WRAG, you have been judged as being unfit for work so your GP's letter will not be of any help. To get into the Support Group you must show how and why you meet the Support Group descriptors
Qualifying for the Support Group
