Hi
Elaine a wee tip, send your SAR, to the Data Controller, and send seperately from your GL24
The ESA 56 is the worksheet for your work capability assessment and your scores will be on the back

Yes, send any SAR in a separate envelope by itself.

It is highly unlikely that there will be a score sheet in the OP's case.

That's why I advise to request "ALL" documentation used in coming to the decision, to cover all bases, as we cannot be certain which ESA documentation has been generated.

The ones that are generated in all cases are The ESA85/A and The LT54.

Hi,

We sent in the GL24 and asked for the medical report which we got back. It seems the GP wasn't being too kind!
Sorry, but I have only just read page two on this thread and we have not requested an SAR, is it essential?
We know they received the appeal as the interview was done over the phone and the PA confirmed it. That was 4 weeks ago. We didn't put much information on there just that we were wrongly informed etc.
What do we do now or do we just have to wait. I'm not sure we can provide them with anymore information.

Hi Elaine,

If you have received the paperwork that you wanted then there is no need to submit an SAR. If you want to see everything the DWP hold relating to this claim you can submit an SAR as detailed elsewhere in this topic/thread.

as you do not have any additional information/evidence, it would be worth writing to DWP pointing out the information that you have already sent. Show them clearly how you meet the Support group descriptors and where this information is to be found in the ESA50 and anything that accompanied it.

Other than that, all you can do is wait. It can take up to 6 months for the reconsideration to take place and the appeal, if still needed, a few months after this. On the other hand, some claimants are finding that their area is getting through things much more quickly than this - let's hope this is the case in your situation!

I will re-check all the paperwork that was sent.
In your opinion, what is your hunch about the outcome of this? bearing in mind how debilitating the nature of the problems/illnesses.
After a year will she be entitled to any benefit at all if we are not successful?
We went to Citizens advice but they weren't very helpful at this stage.

I'm sorry, there is absolutely no way to predict the outcome of your appeal.

If the claimant remains in WRAG, this will be means-tested after 365 days. You can look at the 'Turn2us' website to get an idea of whether there are any other benefits that could be claimed.
