hi all, i have not long had the dreaded esa50 through the letter box from atos, although after winning my appeal at the end of January it was recommended that i was not reassessed for 12months is it worth ringing up the DWP or will i get no where, i don't necessarily mind as my condition has worsened since then and i would hope to get in to the support group,
secondly if i had to go for a medical again and get stitched up would this affect my DLA,

Hi h 1,
I see from your previous post that you were placed in The WRAG, and your 365 days entitlement to payment has been exhausted. :

You could challenge the reassessment before the end period recommended by the Tribunal, indeed some members have recently been successful in doing this.
However, as you may know, it is only a recommendation and has no legal standing.
If you feel that your condition has deteriorated to such an extent that you may gain entry to the SG this time, then it could be to your advantage, as if you do, your CB ESA payments would be reinstated, and remain in payment for as long as you remain in the SG.
It is hard to say whether a negative result gained in this reassessment would have a detrimental effect on your DLA.
We have heard of this with a fit for work decision, for this to happen, there would have to be information within the ESA Medical Report that was contradictory to your current DLA award.
Remember, to a large extent the ESA qualifying criteria is much different and stricter to that of DLA.
In case you are not aware, the ESA50 changed 28/01/13 so did some of the legislation.
