P45 Incapacity Claim Form was created by Cat
Today I received by post a 3 page form titledP45 Part 1A Incapacity Benefit Claim, Details of employee leaving work, New employee details.
Can anyone tell me what this is about?? I do pay Tax on my Incapacity Benefit as I have a medical retirement pension. Do I have to do anything with this form?
I have been placed into the WRAG group after which time 365 days I do not expect to receive any further monies as my husband has a decent salary and I have a pension due to ill health when I was medically retired.
I am going to appeal should I base my appeal on the fact that whilst they did contact my GP they did not contact my CPN nor my Psychiatrist for a report on my medical/mental condition. My GP's words to me were when I told her I had been placed in the WRAG group good luck to them trying to get my back to work.
I did ask them for a copy of the paperwork they used to assess my claim but all I have received is the GP report which states basically that I live rural and I get to my appointments by car and details my medical condition.
Or is there some other criteria the appeal has to take the shape of?

Hi Cat,
don't worry, it is usual to receive a P45 when your IB claim has ended
I have received a P45
I'm afraid that DWP are not obliged to contact your GP or consultant for further information (at the moment). Your appeal should be based on the fact that DWP have not recognised the severity of your condition. In particular, you must show how and why you meet the specific Support Group criteria

How to submit an appeal
It will be helpful to contact DWP and request a copy of the ESA85 (if you had a 'medical') or ESA85a (if you did not) to find out the basis for your WRAG award. However, you should not wait for this to arrive as the appeal form, GL24, should be submitted within one month of the decision letter.

Is there any risk to challenging a decision?
You are obliged to attend WFIs while appealing, if you are asked to do so. However, if you phone the advisor (the name will be on the appointment letter when it arrives) it might be possible to have thse suspended, or carried out over the phone. This is entirely at the discretion of the advisor.
