help please

iggy4 wrote: hi everyone my name is john, and i have just started the process of filling in the Esa50 form.i have been on Dla for some time now as i have queite a few things wrong with me ,to mention but a few,,,,i have severe degenrative bone disorder in the bottom of my spine,very painfull when it flares up.i had a triple heart bypass about 4 years ago now,they couldent fix (i needed a triple bypass)one of the vains as it was too small ,as a result i still get chest pain and out of breath very easy.i have a prolapsed disk at the top of my spine(already had one removed)and this causes pain all across my shoulders and down my back,i have arthrytis in my fingers and my hip ball joint.,i have (what they call)a halders nail drilled from my elbow through the bone all the way up to the ball jointin my right arm,this was from an act of violence against me,i was dragged from a bus in daYLIGHT AND BEATEN UP HE PUT MY ARM OVER THE CURB AND STAMPED ON IT,(ID NEVER SEEN THIS MAN BEFORE NORE HAVE I SINCE HE WAS OF POLISH ORIGEN ,SO THIS LEFT ME BEING AFRAID TO GO OUT ON MY OWN AND I DONT TRAVLE ON PUBLIC TRANSPORT (sorry just noticed caps on),there are many things wrong ,and now to top it all of i have just been in hospital with a very bad liver,i got asysis.and varigus bleeding in wich i nearly died.then they tell me that i have a cancer growth on my right kiddney,and i suffer from cronic depresion.this Esa50 form is a joke,iv just phoned all 3 departments and told that i carnt have an extention to fill the form in as i need dart(same as c a b)to help me fill it in,i was shocked by the way they spoke to me.saying A DEAD LINE IS A DEAD LINE,well me and my wife are really at our wits end.i dont even know if the cancer has spread or not untill friday when i go see the doc.can someone tell me why they ask for things like your bank account details ,im sorry to go on ,but we really are at are witsend.tyhey wouldent give me an extention but said my money will be affected if its not on time,,,,help please.im getting sucidle.

I am afraid that is not clear from your post whether;

- this is a new claim for ESA,
- you are being transferred from another benefit such as IB to ESA, or
- you are already in receipt of ESA and this is a re-assessment.

If this is a new claim, then ignoring the financial aspects, you can close the claim to allow you to deal with the other problems you are facing, you can then make a new claim when you are more able to deal with things which can be backdated for up to three months.

In the case of a transfer or a re-assessment then I am afraid your options are significantly more limited.

A failure to return the ESA50 can, not will, result in your claim being closed and all payments being ceased, whilst this is appealable, it can take months to resolve, during which time you will still not receive any payments, and there is no guarantee that you will be successful.

If your ESA50 is returned late then you also run the risk of your claim being closed, however, the return of your ESA50 should simplify the process of getting it re-instated.

You can return the form incomplete, with an explanation of why you have not provided more detail, I do not recommend this, but it remains an option. It will almost certainly result in you being required to attend a face to face assessment, you may avoid this with a more detailed response.

You mention the possibility of cancer, if this is confirmed and you start chemotherapy or radiotherapy or can expect to within six months, then you should contact the DWP immediately as this should now exempt you from needing to complete the ESA50 and should place you in the Support Group, you will of course need medical evidence to confirm this.

I would send copies of your evidence with the ESA50, but there is no harm in you taking an extra copy with you to the face to face assessment, especially if this is related to your receiving cancer treatment, see my previous post above.
