Won ESA Tribunal WRG to SG what next? was created by tabby026
Hi I won my ESA appeal today from WRG to SG. The decision was originally made in July 2012, so I assume that I will get any backdated money from then? If so how long does the back payment come through and when will I start to get my new fortnightly rate?
The Judge has advised the DWP that I not be reassessed for 18 months. Is that from todays date or when I had my medical in July 2012?
Also when I get reassessed will I have to complete another ESA50 questionnaire and attend a medical?
If anyone could help/advise I would appreciate it. Thanks.

Congratulations on the award.
The difference between the WRAG and Support Group rates is about £6 so you should be paid a lump sum from the date of the previous Decision, from your post this would be July of last year or some time later. It is not the date you were assessed but the date of the letter notifying you of the Decision!
If the DWP are working correctly it should take 5-6 weeks, you may be able to reduce this slightly by contacting the DWP and faxing a copy of the Tribunal Decision notice to the relevant Payments office.
The 18 months should be from the date of the Tribunal, the re-assessment date for ESA is not part of the award, so the DWP can re-assess you at any time they choose, however, members have had some success at challenging an early re-assessment.
Unless you meet the Exemption criteria you should expect to receive a new ESA50 when you are re-assessed, it will depend on how you answer the questions and any evidence you supply as to whether you will need to attend a face to face assessment.
