Went on Friday and got letter the next day saying I failed on trying to get into the support group from contributions Wrag,the interview took only ten minutes and the first question was about my vibration white finger that I had answered wrong in my esa50,that IMO was done to discredit me in further information,he then started asking me questions on my ability to walk which was what I was using as my argument to get into the support group,the doctor who was there looked disinterested as though he knew the outcome before hand and sat with one knee on the floor sitting crouched,my wife came with me and she works as the admin officer for a council and she said afterwards that she knew after a couple of minutes that I would fail,they totally degraded my MRI scan and neck X-rays that showed significant degenerative disc disease and bulging in seven discs,I've said earlier that certain people will be targeted more than others because I have a works pension and I know other people in the same boat as me who think the same way,why because I've worked hard and contributed to insurance and taxes should I have my money stopped because I have a works pension,I mean no disrespect by the way to others that have had disabilities all there lives or don't have work pensions,but it seems as though I'm being penalised for having the gall to have a works pension,don't know what to to do now but good luck to everyone else who are in the same predeciment as me and I would like to thank gordon and bro58 and mrs hurtyback for the excellent work you do on this great site.

Thank you for your kind words Phil. I am sorry that they do not come under better circumstances.

Having failed your appeal, I'm afraid that you are probably at the end of the road as far as this decision is concerned. Your only possible way forward would be if you could show an 'error in law' from the tribunal.

Your first step would be to request a 'Statement of Reasons' from the tribunal service

However, you need to be aware that a copy would also be sent to DWP and give them the chance of look for an Error in Law themselves.

Failing that, your best chance would be to be put into the Support Group at a future reassessment, your payments would recommence if that happens. You will be reassessed periodically as long as your ESA claim remains live, this can include another face-to-face assessment as well as ESA50.

I am not a big fan of conspiracy theories and I am 'lucky' enough to be in the Support Group despite having an occupational pension. What I think of my ESA being reduced as a result of this pension is probably not fit for public viewing and is certainly outside the remit of this forum! :angry:
