I am currently trying to filll in my reassessment form. This is the first time i've had to do it myself because I used to have a MH support worker that did it for me. I'm finding it extremely difficult, more so than ESA! I've decided to 'copy' most of her answers from last time but bring it more up to date. I currently have the maximum award (HRC/LRM) for MH, but as far as I can see she only gave one example for each question. Is one enough this time or should I give 2 or 3? Also I recall a couple of weeks ago that someone said she/he put the same answers for DLA and ESA and they were told it wasn't a good idea, but I find that my answers could be the same also (even the ones that the MH worker gave). So am I looking at DLA the wrong way? I know it's about care needs but on the ESA q12 for example you have to explain why you aren't aware of danger etc and why you can't do it, but then it asks if you need supervision? So would it be alright to turn the answer around for DLA and say "I need supervision because blah blah blah? I'm more confident i've got ESA 'right' because I done that myself before, but DLA is a minefield to me! I have read the guide. Also I note that you up your chances of seeing a doctor if you claim to have a severe mental impairment. According to my ESA SG award I have a severe functional disability. I presume that's different as I didn't have a medical the last time, it was all paperwork?

Hi mg,

I think DLA claims can be more difficult than ESA because there are no specific descriptors to match to your condition. Although ESA and DLA have diferent criteria there is still going to be a lot of similarity in what you write as your conditions and impairments remain the same no matter what forms you have in front of you!

It is very hard to say whether or not you are likely to have an assessment from a doctor as part of your claim. You should do the best possible job of filling in the form and see what transpires.

Trying to answer your questions in order.

There is no rule as to how many examples you should, or should not give. My suspicion is that your MH Support Worker filled the space available on the form, and that this only took one example. Examples that simply repeat or re-use the criteria of the previous one, probably do not add much to your claim, but if for example for Question 37, Washing, bathing, etc., you answered that due to depression you do not wash on a frequent basis and then as a second example, stated that due to exhaustion you physically could not wash, then this would be a good use of multiple examples.

The issue with simply copying an ESA answer to a DLA form, and I am taking it literally, is the applicability of the answer, in some cases, mobility for example; the ESA test is more strict, but even then there is a danger that you omit information that is important for DLA, such as the manner of your walking and the time it takes you to walk a specific distance. For most of the other questions there is no overlap and where there is, continence for example, DLA is orientated to your care needs, what help do you need because of your incontinence, whereas ESA is more interested in the empirical effect, e.g. how often.

So there is no problem basing your answer on those given on the ESA50, but you still need to ensure that you modify them to fit with the requirements of DLA.
