esa payments was created by Bertie
Hi , i have just received a letter saying that my wife's contribution based employment and support allowance is due to end .
She is still in the process of appealing an ESA decision ( 11 months ago ) and thought she was on reduced ESA still supplying sick notes .
There has been no contact regarding an appeal date can anybody advise on what to do next .

Hi B,
I am afraid that you are only entitled to 365 days payment of CB ESA, whether that be at the assessment rate whilst appealing a fit for work decision, (which seems to be the case with you) or whilst in The WRAG.
Your next step would be to consider whether you are entitled to IR ESA. You would have to pass the means test with respect to household income, capital, assets and savings.
You would have to request and fill in an ESA3 Form so that the DWP could financially assess you.
If you are not entitled to IR ESA, then payments will cease.
If as a result of your appeal, you are placed into The SG, then payments would be reinstated and any arrears owed from the date of the adverse decision would be payed.
If you are placed into The WRAG as result of the appeal, then as far as any further payment of CB ESA is concerned it would not help things, although you would be entitled to any arrears of The WRA Component owed from the date of the appealed decision.
See :
12 Month Limit for ESA(CB)
24 hour work rule for ESA(IR)
Asset rule for ESA(IR)
Sample ESA 3 Form
This : Benefits Calculator may give you some idea whether you would be entitled to IR ESA, although you would still have to fill in an ESA3 Form.
