Hi I was placed in the WRAG but believe I should be in the support group due to various health condition so I asked for a reconsideration 6 months ago. A month ago I was sent another ESA50 form and was told until Atos had me in for a medical I would receive no answer from benefits place. Can you please advise whether I should just wait or write in and ask for an appeal because it is taking so long. Advice would be much appreciated.

Until it is overturned the Decision to place you in the WRAG remains in place and as a result you can be re-assessed as normal, which I assume this new ESA50 is in connection with.

This being the case, then the statement that the DWP are waiting for the result of this assessment in regard to your Reconsideration is incorrect. The Reconsideration is in connection with the previous Decision and your current health is explicitly excluded from this process.

Our normal advice is to appeal, a Reconsideration is done as part of the process and claimants can often save weeks if not months by going direct to appeal, however, once you receive a decision on your Reconsideration you can still make an appeal.

If you do now choose to make an appeal you should complete a GL24 Appeal form, you will also need to provide Good Cause why the appeal is late, although this is not usually a problem for ESA.
