They’re going to pay me the assessment rate of ESA without a fit note, backdated from when my Incapacity Benefit stopped.

In a separate letter they say they’re sending a form GL24, although I sent one which said “Please see enclosed letter”

I don’t see my GP for my back as there’s nothing she can do for it, I see an Osteo and Physio. My GP won’t give me a fit note to say I’m unfit for work. She says I am fit for work, and was quite nasty when I asked. A completely different doctor to the one I usually see. I think she underestimates the severity. Luckily my Osteo wrote me a report. My Physio said they would have to ask for one. Fingers crossed.

Hi Ae,

Sounds like another DWP "cock up" here.

If you were assessed as "fit for work" as a result of your conversion over from IB, and the ensuing ESA WCA, then you would still be classed as "fit for work" until you gained a fit note (Med 3) from your G.P. to state that you were not fit for work.

Therefore, to receive any benefit, you would have to sign on for JSA.

It points even more to a "cock up" in so much that they state that they are sending you a GL24 appeals form, when it appears that you have already submitted one.

To be entitled to assessment rate of ESA whilst appealing a fit for work decision, one must obtain a fit note from their G.P. to cover them from the active date of the fit for work decision. This should be enclosed with The GL24. (Where possible)

Hi Ae,

You could try a different G.P. in the practice. You need a fit note if you are appealing a fit for work decision, otherwise you wont receive assessment rate ESA.
