I am coming up to near the end of my 365 days of ESA ,a couple of weeks ago I got sent a new form to fill in and send back to Atos ,my condition has worsened since my last assesmet where I was placed in WRAG.I have just had hip surgery and have further surgery possibly pending as well and have given all the relevant information to them ,what is likely to happen next will my benefit end or will I have the chance to extend it

Hi H,

If you are placed into The SG as a result of the reassessment that you are presently undergoing, your CB ESA will continue to be paid as long as you remain in The SG.

If you are again placed into The WRAG, then your CB ESA will cease once you have exhausted the 365 days from the start of your current, original WRAG award.

You should then be assessed financially with respect to your capital, assets, savings and household income, by filling in an ESA 3 Form.

If you can pass the means test for IR ESA, payment will continue and there is no time limit whilst in receipt of IR ESA in either group.

If you were placed in The WRAG once more, then you could appeal that decision. However, unless you are entitled to IR ESA, or are placed into The SG as a result of a successful appeal, you would receive no further payment and would receive NI Credits only.

thank you for swift reply ,my forms had to be with Atos by the 12th so hopefully I will hear something soon. Since joining this site I have found out that I have been given so much misinformation from my Job centre advisor about all of this .

Hi H,

Unfortunately, many of our members have fallen victim to misinformation given out by The DWP, especially over the phone.

Looking further forward, if you were to be placed into The WRAG once more, and your appeal was unsuccessful, or if in the interim period of waiting for your appeal to be heard, your condition deteriorated or you started to suffer with different conditions, to such an extent that you felt that you should qualify for The SG, you could request a supersession/review.

Again, if you were then successfully placed into The SG, payment of CB ESA would be reinstated.
