hi I attended a dla med 3 months ago,they found in my favour,said I was receiving the correct rate, for the appropriate time?, today I recieved a esa letter telling me they are going to phone me and then send me yet another form, then I will have to attend a medical, I am pulling my hair out, I reach 65 on may 5th next year, and it seems they are making a sustained effort to get me off , it really is making me feel even more ill. I have attended many medicals since 96 but things seem to be getting worse, is there anything I can do. any help or encouraging words would help. pixietina.

Hi p1,

Unfortunately all IB, IS and SDA recipients are being transferred over to ESA.

The only exceptions are for those people who reach State Pension Age before 6th April 2014, see :

You may now receive a "courtesy phone call" which you do not have to take. Then, within a fortnight or so, you should receive an ESA50 Questionnaire to fill in, which must be returned to ATOS by the deadline given in the accompanying letter.

Hi p1,

As I see that you have had a DLA "medical" recently, you might want to request a copy of the medical report that would have been written as a consequence of the "medical".

Even though the qualifying criteria for DLA and ESA are different, if there were any positive aspects within the DLA medical report that were supportive to your ESA assessment you could use them in evidence along with the ESA50, see :

DWP Data Protection Policy

You should address any SAR, FAO The Data Controller at the benefits office dealing with your benefits, (not DLA) Write DPA 1998 SAR in front top left corner of the envelope.

Once received, the DWP have 40 calendar days to comply. If you haven't received the requested documentation by the time to return your ESA50, you should not miss the deadline.

You can send any new evidence obtained, to ATOS/DWP, after the ESA50 has been returned.

hi I am in the process of waiting for my form for changing fron ib to esa, I am very worried that the medical may be called in dec when my son in the forces is getting married, as he is getting married abroad I wont be available for that 2 weeks. can I do anything should that be the case. I had my curtisy phone call yesterday. I am hoping that if I include the med results from my dla descision three months ago and with my other evidence I wont have to have a medical, but up to now in 20 odd years I have never been that lucky. lots of thanks to benefits and works, because just knowing there is someone to listen helps greatly. pixie.

Hi p,

If you have had the phone call, you should expect the ESA50 to arrive through the post within the next fortnight or so, if it doesn't, you may wish to contact ATOS to ensure that it has not been lost in the post.

You should stipulate any dates that you are not available to attend a face to face in your ESA50, there is however no guarantee that they will abide by any such request.

You are allowed to rearrange a face to face once. This can be done if necessary by contacting ATOS :

You may wish to bare in mind that assumptions may be made, with respect to any mobility/standing/sitting limitations that you suffer from the fact that you have been able to travel abroad.

Of course, if you can provide enough paper evidence with the ESA50 there may be no need for a face to face.
