Hello everyone,

I had a nervous breakdown and was signed off sick in Dec 2002, a yr later my job of 7 yrs was no more. I got Incapacity benefit and this was topped up with income Support.

I have been diagnosed with Bipolar, unstable emotional personality disorder, panic attacks and severe anxiety, claustrophobia, agrophobia, paranioa and I have had a life long history of suicide attempts and sel harm. I am medicated also.

I also have high blood pressure.

I completed an ESA50 questionnaire last yr, and had 2 attempts at the medical but didn't quite there due to panic attacks, on the 3rd go I managed it, this was 26 November 2012.

2 weeks ago today I received a letter stating I didn't qualify for ESA and my incapacity was to stop on the 10th July 2013. This decision was made on a face to face medical assessment only as they said I had failed to return my ESA50 questionnaire.

I replied stating this that I did return my ERSA50 questionnaire and told them exactly what was included with the form. I informed them that some things had not been mentioned in this assessment report and that some things were untrue. I also informed them that I wished to appeal against this decision. I posted the letter and paid for a recorded delivery. I have today had conformation od delivery and that was the following day after posting it - 4 th July 2013.

I rang my bank to see if my money had gone in and it hadn't. Well since then Ive been a mess, I havnt been advised as what happens now, what the hell do I do next, I will for certain now lose my home, my home ive been in for the last 22 yrs.

I am begging anyone here to pleased advise me what I can do now, when will I receive any money, why have they not responded to any of my letters.

Hi Kim,

I'm sorry that you are having such a hard time claiming ESA, the system certainly doesn't help people with mental health issues!

I'm afraid that I cannot tell you why DWP are not answering your letters. What I can tell you is that you will be paid the ESA assessment rate once you have formally appealed and submitted a new 'fit note' from your GP

Hi,

Well, I read a letter from the DWP which i received 26th june 2013, it stated that as i am a carer i would be entitled to income support and if i was this would be from 11 July 2013 but they would however write to me about this.

No money in bank and no letter.

It looks like everything has stopped, help towards the interest on my mortgage, council tax benefit, income support, incapacity I get absolutely nothing! What the hel;l is going on here.

These people may have got my home repossessed, were's my human rights here, i have a children to provide for, 1 of them being disabled.

Do these people know they are ruining lives literally

This is truly awful !!! :(

If the DWP have received your GL24 appeals form and a valid fit note from your G.P., then you are entitled to Assessment Rate ESA.

You could seek professional advice :

You can also e-mail your M.P. and complain, they may speed things up :

Hi k,

If you ring the DWP Benefits Office 0845 number on any letters that you may have, you will get through to a call responder in a call centre.

These are generally pretty useless in complex scenarios such as this.

Ask for an escalation, and a call back from a manager or supervisor, they have to comply with any such request.

Tell them your circumstances, and that you are considering involving your M.P., it may help.

To receive payment while you are challenging the Decision that you are Fit for Work, you need to have made a formal request for an appeal, this must be in writing either as a letter or on a GL24 appeal form, you also need to provide a Fit Note covering you from the date your ESA was stopped.

To receive Income Support as a Carer, you must be receiving or have an underlying entitlement to Carers Allowance, to receive this, the person you are caring form must be in receipt of DLA at either the Middle or Higher rate of Care. This being the case you should be able to continue to receive IS from the date that your ESA stopped.

I know that it can be frustrating and expensive to call the DWP, but it may be the most effective means to find out what is going on with your claim, I will warn you that the Call Centre staff may not be able to provide the information you need, but you can request a call back from a Customer Manager.

I would also advise you to get face to face advice, firstly to help you deal with the difficulties you are having currently with the DWP, but secondly to help you understand what will be the best solution for you in the short and long term.
