My income support and incapacity benefits were stopped in April 2013 due to failing to attend a medical assessment. I called the jobcentre that deals with my claim who asked me to provide them with a reason for failing to attend the assessment.

I explained to the advisor that the reason was provided on the failed to attend form I could not attend the assessment and be at the emergency eye clinic at the same time. The advisor asked me to leave it with him and call back if I had not heard anything from them or any payments.

I contacted them again after 10 days this time the advisor said she could not explain why I had not received any payments as I had been transferred to ESA support group I should leave it with her.

I received one payment then my payments completely stopped so I chased up again this time to be told that the decision maker did not accept the reasons I provided for not being able to attend which require me to make a new claim I refused to do that and explained again why I could not attend she transferred me to reassessments who said a letter had been sent out explaining the decision if I hadn't received a new one would be sent in the post. I explained again I don't have any letter from the DWP and why I couldn't attend she said we need a hospital letter confirming you were at the hospital.

I send in the hospital letter recorded delivery which they received in June 2013, I telephoned them again to chase up and was advised to call back in 10 days if I'd not heard anything.

Ten days passed and no correspondence so I telephoned them again this time the advisor said they are not allowed to provide a time limit for which they may get back to a claimant saying the previous advisor she apologised on behalf of her colleague who made an error. I then asked her how long am I supposed to wait for a response she said she couldn't tell me it's with the decision maker they can take all the time they want. When they have made the decision they will get in touch with me.

It's been almost three months I haven't received any payments is there anything I can do to speed up the process. I feel I may end up with a bad credit rating as I have bills to pay and I'm really struggling.

Please could someone help me out I would really appreciate it. I apologise for any typos my vision is not good.

The problem you have is that failing to attend is classed as a technical failure and you will not receive payment until the matter is;

- revised in your favour, or
- you make a new claim for ESA and attend an assessment, or
- six months elapses from the date of the Decision that you are not entitled to ESA.

To be honest the call centre staff are often unable to give you accurate information about what is going on as they only have access to what is detailed on the computer system, so I would recommend that the next time you ring you ask to speak to a Customer Manager, this usually requires a call back, but they should be able to tell you what is actually going on.

Thank you Gordon for your reply. I was not able to post what I wanted to correctly yesterday due to a flare up of symptoms.

I actual did not fail to attend I did ring atos and notify them that I would not be able to attend, also I did received a callback from a manger I believe.

She did request the documents which I have sent in. I don't know if with this clarification you are able to help me further.

If you are able to I would appreciate and like to thank you in advance.

Was this the first ATOS appointment that you missed?

Did you re-arrange a previous appointment?

It would be unusual for ATOS to return your file to the DWP for only missing one, as their normal procedure is to do so after a claimant has failed to attend a second appointment.

From your post, the last person you spoke to at the DWP was in the call centre, so my advise is to phone them on Monday and ask to speak to Customer Manager.

Many thanks Gordon for your reply. I did ring again and was provided conflicting advice the advisor had a look through my notes and said she did not know why claim had been stopped, maybe I need to speak with the ESA department I explained to her I'm not receiving any benefits so would like to speak to a customer care manager.

The advisor said she would put in a request with the Jobcentre that deals with my claim. Someone should call me back me back and advise me appropriately.

I received a phone call from the department I spoke to a very helpful pleasant speaking customer manager.

She apologised for the ongoing process also apologised that she was going to request that I get another copy of the letter from the hospital or the GP surgery and attend in person to hand it in.

She said has received the one I sent them but has to apologise for requesting a copy of the same letter again, if I was not well enough to attend I could have someone drop the letter of at the Jobcentre.

She gave me a number to ring once I've got another copy so that they can arrange an appointment for me or the person who will be going to provide them with another copy.

I don't understand is this normal that they request the same letter again even if they already have a copy? I send all correspondence recorded delivery.

I think they might have some identification doubts hence the request to attend in person if possible. In this weather I would not be able to attend myself as the heat affects my vision and other symptoms.

I am going to send a copy with a relative but then they might still ask me to attend in person which is currently not possible.

Any tips or advice on how to go about this? Is it worth risking a flare up of my symptoms and attending in person?
