ESA appeal was created by Willow123
I have have been on IB sine 2004, and won by Medical on appeal twice with points. I hqave been moved to ESA and have also the points to be the support group. I have an appesal date is it worth appealing because they say it ended on July 6th and because I have received 365 days contribution based esa which thet is the maximum. In order to continue being credited with NI contributions I may be required to attend work cpability assessments. I have enough points so am I better to appeal for some reason. or go into work support.:

Hi Willow,

I am a little confused by your post. I think you are saying that you have been put into the Work Related Activity Group of ESA and are appealing for the Support Group. Is this correct?

You need to know that the Support Group is not points based but is awarded solely on whether the claimant meets very specific criteria

Qualifying for the Support Group

I assume that you must have been awarded ESA on 6thJuly 2012. Do you already have an appeal submitted? If not, you have just a few days to do so as there is an absolute maximum of 13 months (from the date on the decision letter) in which to do so.

Time in the WRAG is limited to 365 days contributory benefit but there is no such limit for claimants in the Support Group. If you were placed in the Support Group at appeal the clock would be reset and it would be as if you had never been in the WRAG.
