Had medical received the letter I was not entitled to ESA I have a back and hip and knee problem issues as well as having stress and urge incontinence, which of course means I start to leak urine, and I do at times have to change my clothing at times but I got 0 points for the incontinence What is put down for the O point is states unfortunately incontinence which occurs due to the time taken to get to the bathroom because of mobility issues does not satisfy the criteria in this area.

Have requested the information you advice in your section for members guides. It has taken 56 calendar days to get to us. There are a large amount of information on this form of things that didn’t happen, the lady who did the medical on me told me she had no medical background. Yet she puts her name and then puts Registered Nurse.

Where do we go next in this process as its taken so long to get this information.

I'm sorry that you are in this situation! Have you actually already submitted an appeal? This is supposed to be received within one month of the date on the decision letter. However, DWP are currently accepting late appeals with no problem, as long as you explain that the delay was caused by waiting for further info re your decision (if you should be in this situation in future, get a basic appeal submitted first and then send more info as and when you have it).

Once DWP have received your appeal, and a 'fitnote'/med 3 from your GP, you will receive the ESA assessment rate until an appeal has been decided in your favour or £^% days has passed. If the appeal has not been heard within 365 days (as is possible) payment would cease unless you were entitled to income-related benefit.
