I have received my bundle following an SAR. Most of it is documentation I sent to them, but the ESA85a is missing. The ESA113 is, in my opinion, unhelpful. The comments made by the GP I last saw are misleading. During the consultation he barely looked at me and I had to explain things he should've known. On the form the dosage of my meds is wrong or missing and there was no mention of the arthritis I have had for nearly 20 years. I have since learned that he has retired. He states that at my last visit my mood was "mellow". He was about to take away the drugs that help my severe anxiety and I don't think I have ever been mellow! I think he was describing his own mood in contemplation of his retirement.

I suppose I will have to write to the DWP and ask AGAIN for a copy of the ESA85a. I am worried about the time limit and wonder if they will accept further documentation now that they have my GL24. I outlined the reasons for appealing, but didn't go into detail as I was waiting for copies of decision docs. The only positive note is my re-referral has been increased from 18 months to 2 years

Just for your information, I am still waiting for my appeal to be heard from last year's assessment!!

Did you specifically request the ESA85A or was your request generic?

If you did request it then you should be able to go directly back to the DWP Data Protection Dept. as they have failed to satisfy your SAR, this may well be quicker than making a new request, even if you did not specifically identify it I would still try this as a first pass.

Hi t,

We have heard from other members where they have received documentation regarding a SAR, and some docs have been missing.

Apparently the DWP Data Controller sometimes provides an e-mail address where you can contact them directly.

If this is the case, you can try that, it may save time.

Thanks Gordon, yes I did specifically ask for the ESA85a and used the template on this site.

Thanks also Bro, there is an email address on the letter. I will contact them on monday.

How long do I have to send in more supporting evidence for my appeal? I would like to increase my chances for a revision before I end up waiting for two appeals running together.

Hi T,

They used to give a period of 11 weeks as a guide line for a reconsideration to take place.

We have had varying reports from members were a reconsideration has taken from a week or so to several months.

Therefore, my best suggestion would be to provide any evidence that you wish to be considered by the reviewing DWP DM, ASAP.
