ESA AND STATORY SICK PAY was created by swimming
Hiya everyone

I was put into the support group july for 2 years , and I get contributed esa.

The problem we have is my husband as been on and off work, 3 times since February with slipped disc, where he lost the use in his foot and leg. we don't get any other benefit than my esa £106.00 a week. and he only gets statory sick pay.

£86.00 a week, that's why he kept going back to work, to try and pay the bills. I went to citizens about food bank and they as long as he was getting £86 a week, we had to buy food and not pay the bills. cannot believe it, my dad as been keeping us on and off (bless him).

They have told my hubby that he will probably need operation, and doctor advised him on extreme physio and no work until it gets sorted.

someone told me that I might get income based esa, but will they make me go all through my esa again from the start, as I only just got it for 2 years in support group. we just need a little advise, I phoned the dwp and she just said I got to fill all the form in.

regards

Hi s,

There is a possibility that you could claim IR ESA for your hubby, this would involve you filling in an ESA3 Form to assess you financially.

As this would not be a reassessment of your SG award, as that is done with an ESA50 it should not affect your SG award.

You will be financially assessed on your capital, assets, savings and household income.

If your hubby works over 24 hours a week this may preclude you from IR ESA :

24 hour work rule for ESA(IR)

Asset rule for ESA(IR)

This : Benefits Calculator may give you more insight.

It would be best if you could obtain professional advice :

Where to get advice?

If your husband is going to be long term sick from work, and has enough NI contributions, he may be able to make his own claim for ESA.

Again you should gain advice.

If your husband has been working and receiving NI Contributions, then he should be able to make his own claim for ESA(CB) once his Statutory Sick Pay has ended.
