Hi,

Got my decision today I have been placed in the work related activity group despite 3 different Nuerosurgeon and 2 Neuropsycholigst report plus my GP recommendation.

I have suffered a major brain injury and I use two elbow crutches and a mobility scooter.

Despite that they want more evidence if I want to appeal

Sorry to hear this !!, although being placed into The WRAG means that you are unfit for work.

Disregarding what your disabilities or medical conditions are, to gain access to The SG, you must prove that you fulfill at least one of the qualifying functional descriptors :

SG (LCWRA)Schedule 3 Descriptors

Or qualify under ESA Reg 35. (2) (a) & (b) with regards to substantial risk. :

It may already be the case that you have provided substantive evidence regarding your disabilities, and that they are not being tied in to the relevant qualifying SG Descriptors.

Therefore, it may simply be enough to reiterate your evidence, highlighting how and why the limitations caused by your disability, qualify you for the relevant descriptors. (Cross-reference)

Many members have had a successful appeal/reconsideration from WRAG to SG, simply by doing the above. It is not always necessary to provide fresh evidence from an HCP.

If you were in receipt of IB (only), prior to transfer, you will therefore be entitled to CB ESA (only) in The WRAG. See :

If you feel that you do qualify for The SG, you have one month to appeal using GL24 Form, which can be downloaded and printed off (you only need to print off the actual form and not all the preceding advisory notes) from the link on this page :

You could also request the ESA85 Medical Report, which should tell you how long your WRAG award should last before reassessment, and may give you some idea why you did not gain entry to The SG.

This can be done by ringing The Benefits Office on you WRAG award letter, but should be backed up with a written request.

There should also be an LT54 Form.

Do not miss your one month deadline to appeal, (If that is what you are to do) if the above documents have not arrived, you can always provide extra evidence as soon as you receive them.

Once you appeal you will receive an automatic reconsideration by a different DWP DM, you should provide any fresh evidence that you may have ASAP, if you wish it to be considered at this stage.
