DLA Award: High Rate Mobility, No Care

Good afternoon

After a home visit medical by an Atos Doctor in relation to my DLA claim, on 07 Oct ’13 I was awarded mobility at the higher rate, but no care. Although I am delighted with the mobility high rate award, I was hoping to receive the lowest rate care which I feel I am entitled to, so would like for them to look at this again by asking for a revision, however I have a couple of concerns and would be grateful for some advice as follows:

If I do proceed with a revision, is there a chance they could reduce my mobility rate, even though I am only asking them to look at the care part?

I really don’t think I could go through the whole appeal process which is why I would just rather ask for a revision, but having read other posts I’m wondering if I should start the appeal process which would have the decision looked at again anyway, and if I have no luck and it goes to appeal, see from there if I feel up to going all the way or not. Should I not feel up to it, can I withdraw my appeal at any stage?

For your information, I am also in the ESA Support Group.

I’d like to take this opportunity to thank everyone at B&W for all the excellent guidance notes etc., these have been invaluable and I’m pretty sure I wouldn’t have got this far without them. :)

Cauda Equina Syndrome (CES);
- Poor mobility
- Back, leg and feet pain
- Numbness in saddle area, top back of legs & vertical half of entire left leg
- Double incontinence
- Catheter use
- Recurring urine infections
- Problems with left heel due to gait as a result of poor mobility

Yes, you need to be aware that requesting a reconsideration, or appeal, means that both elements of your DLA can be looked at. We advise members to make it very clear that it is only one element that they are unhappy with, but I'm afraid there are no guarantees.

Is there any risk to challenging a decision?

Once submitted, an appeal can be withdrawn at any stage, right up to the day of appeal if you wish.
