what can be done for those with no money at all? was created by Wales and West Housing
If you have been through an ESA appeal and lost twice and reapplied for ESA and are waiting for an appointment but are no longer getting any benefits at all whilst waiting for an ATOS appointment is there anything that can be done? This person has had no income for over 10 weeks

Without more information it is a bit difficult to advise, but I will have a go.
Have you or they spoken to the DWP as they should be able to tell you what the problem is.
Failing that.
If they were receiving Contribution Based ESA then their payments may have been affected by the 365 day rule, if this is the case then I would not expect this new claim to be accepted.
If the new claim is within six months of a previous DWP Decision then it is not payable until the claimant has attended an assessment unless they have reported a new condition or a deterioration in an existing one.
If the claimant failed to attend an assessment or to return the ESA50 then payments can be stopped.
Payments will not be made on a new claim until a Fit Note covering the period is received by the DWP.
Irregularities or a failure to supply requested paperwork can result in payments being suspended.
