ESA Tribunal was created by Sue
Went with my husband this morning for his appeal. As soon as we got in the gentleman said that going by the evidence they have been given by DWP he should be in the support group not the wrag. They got him to sign so that they can get some up to date info from his GP records and they hope to get us back before his money stops at end of January 2014. We are really feeling very strange as we did not know that this way existed. We thought you either won or lost. Has anyone had this happen to them as we are really perplexed by it. Hopefully this means he may get moved over to the right group in 2014.

Sounds like good news as long as there isn't anything contradictory in the medical notes. The tribunal can request additional evidence if they feel the DWP have not provided enough to make a fair decision.

You are right that you can only win or lose your Tribunal and you WON :)

Many congratulations.

It does not happen very frequently but it just means that you case was so overwhelmingly in your favour that the panel could not arrive at any other Decision other than to award the Support Group and that is why they did not need to see you.

Once you have the Decision Notice, it may help to speed things up if you contact the DWP and arrange to send them a copy, ideally by fax, it often takes 10 days for the form to make it to the right department before they can begin to process it.

I am confused by the Gordon. Why did the Tribunal want access to the claimant's mecial records if they have already made their decision? :unsure:

My assumption is belt and braces, as you say, they have already announced a Decision.
