Received Atos report. so angry was created by sue
My PIP is still been assessed at the moment by the DWP but they sent out a copy of my ATOS report. Think he saw a different person. There is a whole report about my musculoskeletal system he did not even asses this I walked from the waiting room with the help of my daughter yet he said I walked in by myself and got up from the chair via the chair sided my daughter had to help me up and walk with me to the assessment room. From then on it is all lies. I provided lots of evidence re my conditions. consultation letters, I have been in hospital with one of my conditions in October and January but yet he said I had not been in hospital. Basically everything I said and provided evidence for he said was untrue. I just don't know what to do. I want to be prepared for the DWP award so I can appeal. Or should I ring the DWP and tell them that this report does not reflect what actually went on. This was a review of my health due to my worsening condition I honestly have evidence of my worsening conditions how can these ATOS people blatantly lie. I was firstly given a apt over 20 miles from my home when I rang to request a taxi I was given the appointment on a Wednesday to go on the Saturday and a taxi was agreed, would this have given him time to read through all my reports. Im baffled it appears I am healthier than I was when I went for the first assessment over 2 years ago. Any help would be appreciated ohh I did work from all the Guides and full explanations but the ATOS person basically said that I was lying. He was also a Paramedic, so not specialist in mental health or specialist in Colorectal. This was about my daily struggles and the help I need. He also says he used my 2014 DWP report why when my conditions have got worse it seems that he has used this report and just copied and pasted things. any help would be appreciated. Regards Sue

Hello Sue

Am I right in assuming that you haven't as yet received your award from the decision maker? Until you have been sent your award there is little you can do.

Once you have your award, and if you disagree with it, you can then ask for a mandatory reconsideration (you have one month from the receipt of your award to ask for this.

In the meantime, you can begin to prepare your argument against the assessor's report. Look at the guides on the website and concentrate on the descriptors that you think the assessor has misrepresented/misunderstood; go through each descriptor carefully and point out where you disagree with what the report actually says.

Please don't call the assessor a liar, or get angry or annoyed while you are preparing your argument; you are pointing out that the assessor misjudged the situation, and the more rational and reasonable you are, the more likely is the decision maker to take notice of what you say. It's very difficult, I know, when you are feeling so very angry, but being confrontational really won't help.

You could also query the fact of the assessor using your 2014 DWP report when your condition/s have deteriorated so much. You could also query whether the recent reports from your various Consultants have been referred to in making the decision about your award.

Thank u for your reply. I will take your advice I won't be confrontation. I have not received the dwp award yet so in the meantime will start to to work with the benefits and work forum how to ask for a reconsideration, if the dwp check all my hospital appointments inpatient reports consultant an gp that will show the ATOS assessor has nor checked my paperwork I'm just so confused how he has wrote a full page on a muscular skeletal exam and put I had agreed to this and it never happened no physical exam was done whatsoever I'm just t thankful my daughter was with me throughout the assesment.

Hi Sue, Just a quick comment as my problems are also colorectal and mental health. I have just been having similar problems after having a previous supportive assessment in 2014.

In my MR which I just had they say odd things like I don't have a cognitive impairment; it is upsetting and also things from the previous report they are now saying don't count 'for the purposes of PIP'.

It is hard not to be angry and want to correct them. I am trying my best to stay calm and try and focus on the original assessment and how that was, and how it still applies today, to looking at my own evidence and showing that, rather on their 'odd' arguments and comments on conditions we don't even have... hope this helps a little. Good luck with your MR / appeal.

Thank you for your reply. I'm still waiting for the award from the DWP I'm hoping that they will see all the contradictive evidence from ATOS in one sentence he puts has no specialist input and literally the next sentence he put has monthly specialist input. It's like this all through the report time will tell.

Hello Sue,

I'm sorry to hear about your WCA.

I can't be of much help,as I am in a similar situation with ESA..However I can tell you that I,too had a Health assessor who lied in the report,not just little lies but out and out fraud.I had to have my assessment stopped due to being anxious,and take time out,yet she reported 'no anxiety at assessment,behaved normally'!I could go on about the list of lies,and what they have done,and the anxiety that someone lying in a such a way about your health makes existing health conditions much worse.

It seems as though there is a pattern of decisions being made in a such a way,and probably comes directly from the government.I think they are hoping people won't appeal after the reconsiderations,and cut the figures down that way.

I know for certain if I have to go to appeal,it will be overturned.

I had a PIP appeal,and it was overturned immediately by the Tribunal,who also harshly criticised the DWP,as my health worker contacted the Tribunal to say the DWP had ignored her evidence,which they have also done this time.
