Please be aware: this article deals with the DWP seeking new powers which some claimants may find distressing to contemplate. 

As the DWP steers a bill to give it access to 9 million claimants’ bank accounts through parliament, it is already pushing for additional powers of arrest, search and seizure.  In effect, the DWP is aiming to have its own anti-fraud police force and to be able to impose huge fines without going to court.  But should such plans go ahead?

Lessons from recent history
The current Post Office scandal is clear evidence of what happens when such powers are misused and there are some worrying parallels between the behaviour of the Post Office and the DWP, as we noted earlier this month in Post Office Horizon software originally aimed at claimants

And there is no doubt that the DWP are serious about getting these powers. 

In a May 2022 report entitled ‘Fighting Fraud in the Welfare System’ the DWP said that “we plan to create new powers so our officers will be able to undertake arrests and apply to search and seize evidence in criminal investigations, when parliamentary time allows. This will enable them to act in a timely fashion, without always having to rely on police resources.”

And last year we reported on a survey which the DWP claimed proved that the majority of the public want them to have such powers.

The DWP say that these powers will be used against “serious and organised fraud”, but how long would it take them to decide that allegedly fraudulent PIP, ESA or UC claims by individuals constitute “serious” fraud?

It is important to note that in the same May 2022 report the DWP used exactly the same phrase “when parliamentary time allows” in relation to creating legislation that would force third parties, including banks, to hand over data to them. 

The following year those provisions were slipped into a bill going through parliament and they are now at committee stage in the House of Lords. There appears to be no serious attempt to prevent them going through.

 So a DWP police force is a genuine possibility and the same technique of adding the provisions to an existing bill in order to allow it may be used again.

Huge fines
The same document also explains that the DWP want powers that allow them to introduce a new type of “civil penalty”, whereby they can impose very large fines on claimants they suspect of fraud, without needing to meet the burden of proof required in criminal courts or even to actually take the claimant to court. 

The fine will be based on a percentage of the amount the DWP believe, but cannot necessarily prove beyond reasonable doubt, the claimant has been overpaid.  It will be in addition to the claimant having to repay all of the alleged overpayment.

Your experiences
When concrete plans to introduce such powers are produced, it’s vital that claimants and the bodies that represent them are not caught unprepared and without evidence about what the results might be.

Crucially, we need to know whether the DWP is open, transparent, subject to effective scrutiny and has an ethos of abiding by the rules and regulations that govern its conduct

So, we’d like to know if you have always been treated fairly by the DWP or if you have you been left feeling helpless in the face of an organisation that makes rules, but doesn’t necessarily follow them itself?

For example:

  • Have you tried to report a change of circumstances by phone and been unable to get through?
  • Have you reported a change of circumstances in writing and received no acknowledgement?
  • Have you sent the DWP documents by recorded delivery, but they have denied receiving them?
  • Have you been threatened with legal action if you didn’t repay money without it ever being proved that you owed it?
  • Have you been told you must withdraw a claim for a benefit immediately or face prosecution for fraud, even though you know you have done nothing wrong?
  • Have you been interviewed under caution without being able to have anyone with you?
  • Have you been offered a deal by the DWP whereby you have to agree immediately to accept an award of a disability benefit that is lower than you think you should get or have the offer withdrawn and have to go to appeal instead?
  • Have you been treated in any other way that suggests the DWP cannot be counted on to follow rules and regulations and treat claimants fairly?

    Would it be of any help if people contacted the press with their distressing stories?? Part of the problem is the way the general public perceive people on benefits and that will not change whilst the newspapers have a one sided view. 
    The general public are not likely to read some of these appalling accounts on this forum so shouldn't we think about making them public?

    I sent my PIP renewal form back by the date I was told, yet 2 weeks after that date, they stopped my PIP with no warning, when I checked with them, they did have the forms, and re-instated my PIP straight away, but the money I lost, I had to wait until my next pay day to get back, not once did I receive an apology, or explanation how this happened, I even had to get my M.P. involved and almost 6 months later am still waiting to find out why this happened.
     I fear what would happen to us, if they were allowed more powers, as they already do more or less what they want, with seemingly no accountability for the actions they take, nor apologies when they are proven to be in the wrong

    Totally unacceptable to have the ability to punish without going through a court process+proving beyond reasonable doubt as per court standards. There could be accusations that people feel too overwhelmed by or incapable of due to health, of challenging.

     I suspect the public support was obtained without stating fraud(+ ?if this includes their errors) only 0.2% of welfare bill+that this includes pensions and tax credits(they made huge errors in my case). And the questions should have included ‘would you be happy to have your bank account monitored if you were in receipt of benefits to prevent fraud’ I can’t find the questions to check 

    I was threatened with a fine because I didn’t tell them about my inflation increase in pension (actually about £2), when every year to date the tax has told them-they were slow in doing it. Plus my pension company doesn’t tell me if it’s gone up! 

    I think any powers to go after someone who they think has been fraudulent should be done by an independent agency.

    Every claim that’s clearly been valid (mine+my clients) has had to go to appeal, which had a negative effect on health of those of us claiming. They put up automatic barriers such as if you can drive then you can do everything else. So you have to go through appeal which takes average of 12 months. And you can sense the tribunal’s exasperation at the waste of time and money of appeals when it’s blatant the claimant fulfills the criteria. This also adds to welfare costs to taxpayers needlessly

      @Mim porter One principle of UK law is 'innocent until proven guilty'.  Even murderers and rapists have a right to a trial. Another principal in UK law is ensuring that the state cannot ignore the law of the land and must abide by the laws and not over step their authority.
      I think if this 'policing' idea goes ahead there will be numerous court cases brought against the Government. Once in court they will have to prove guilt.

    I would feel very uncomfortable if DWP were granted these powers. Claimants are in general genuine and should not have to face more scrutiny. I would suggest using more power to prevent wealthy people from not paying a fair tax commensurate to their incomes so service for those in need are improved

    I and my partner were at different times, partner fined £250, for not notifying change of circumstances of about £150 over limit in MT savings.  Myself made to payback monies £2500 that were given erroneously by the DWP after pension age in ERJSA. Despite being their mistake, NON NEGOTIABLE, 

    Its my suspicion Fujitsu will be involved in these spying proposals coupled to AI, without human intervention and lots of people will be penalised with no recourse. Yet one more for the rich, another for the poor.

    I would never trust the DWP in any context, either to be honest or to be competent. It would be more informative and more useful if all political candidates and all political office holders were required  to disclose their bank accounts and all sources of income from whatever sources. That would make some very interesting reading.

    Absolutely not!the DWP is one of the most corrupt government departments there is, they lie ,misrepresent, manipulate just about everything they can get their hands on. They wouldn’t know the truth, if it jumped out and slapped him between the eyes  they already abuse and miss use the powers they already have. If people think the post office scandal is horrific, they would be truly horrified if they actually knew what the DWP do.

    The SOS / DWP should not be given any new powers or any access to bank accounts in any way other than through current practice. They are not to be trusted in any regards including there 'dirty work' contractors. There is a creaping facism problem going on at this time. They are looking for this excuse becuase they have lost the majority of court cases over many years due to the discrimination that they employ on claimant's.

    I don’t trust any government body, it’s been proven with the recent enquiries that they’ve lied, cheated and broken the rules. And as a very dear friend of mine says poop only travels in 1 direction. I made 2 unsuccessful PIP claims before getting a standard award and on every decision letter they either lied or didn’t get the facts right. I think what changed is they realised they couldn’t argue with a local authority as they sent an OT round who assessed me and my flat and ordered multiple prices of mobility equipment and are going to rip out the bath and install a level access shower. I will be putting all benefits into 1 account and once bills are paid I’m pulling out the little that’s left as cash is almost impossible to trace. They have no right to snoop on for the most part law abiding people who’s only indiscretion was to have the cheek to ask for support when the are struggling. This government needs to remember that the real definition of a welfare state system is as a safety net for those who are in need of support. Not as a handout to scroungers which is what they seem to think it is. I’d they want to peek into my bank account I’d think we should be able to look into MP’s and expose the real fraudsters among us. Sorry for the rant if your still with me I’m just so sick of being treated like I’m a criminal when all I’m trying to do is get by.  The real crooks run the country at the common persons expense literally.  Sorry I really am done now.

    I have always been treated fairly by the DWP. once i had to contact my MP John Tricket Labour for Hemsworth area. And everything has been great. The people at Job Centre Plus at Hemsworth could not have been more helpful especially my contact Rob.

    I always write to them as I cannot be bothered to wait on the phone. I don't think I've ever had letters acknowledged. They've been overpaying my Christmas bonus for years (get it with ESA and DLA but you're only supposed to get it once) and I've written to them twice about it with no reply and no action taken.

    Don't have an issue. If your all above board then I really don't see what the problem is. If your trying to inform them that you've came into money then write and use recorded delivery or email then you have a trace. Too many people having an increase in income and not declaring it.

      @Mary You don't see the problem in removing the right to privacy (like a prisoner) from the vulnerable in society? I suggest you think about it a little deeper. A Human right being removed because the person is struggling enough to need help is just grand with you because "we should be ok if we have nothing to hide"? I want my finances private because they are sensitive personal information Mary. I have plenty to hide and none of it makes me guilty of anything if it were revealed.

      @Mary I’m glad that your experience has been a positive one Mary. Unfortunately for others, including myself, it has been anything but. I have experienced outright lying at a PIP assessment on two occasions, including lying about the statements of my friend who accompanied me. There are too many details to go into I’m afraid but unfortunately it’s not always a case of people not declaring a rise in income.

    I'm not in favour of the DWP having any further powers. I've had a multitude of problems over the decades, as a person with complex PTSD & other hidden disabilities from staff misleading me about whether I can claim or not (DLA whilst at university), being bullied out of my degree by staff who terminated my benefits just as I was about to do my first exams & I never recovered from the debts that caused me hence gave up when the DWP were meant to help & support claimants to progress! Also been told many times that I can't challenge decisions only to discover I can, staff unfit for purpose to assess my health & capability to work, being told I cannot get my DLA back-dated, only to discover eventually that I can at least challenge them at tribunal level & most recently since the DWP took over handling the warm home discount I've failed to receive it due to no EPC!
    ICE, the DWP ombudsman appears to be completely in the DWP's pocket but then many if not all ombudsman are!
    What I've learnt over the years is if something feels wrong then challenge it in writing & keep doing so all the way to a tribunal & copy in the Labour Party's policy forum (email address) to push for change.

      @Rob Halcro OMG Rob been through the mill and know what that is like from a Uni perspective I was lucky that my local MIND were brilliant in also have Complex PTSD among other things an also physical disabilities. I too took them to Tribunal once with MIND's help as they refused to backdate my claim even though I had all toe documentation. The Tribunal asked them 3 times for a response to my complaint and they ignored it, so in the end the Tribunal rulled in my favour and I got my backdate. I have heard that quite often if you have all the documentation and you take them to Tribunal they drop it quite quickly and just let the system take it's course. That did mean that they had a few months of doing nothing and not paying me my backdate, but in the end I got it. I urge everyone out there to find a charity that deals with their medical problems as they are always willing and able to help and the DWP often backs down quite quickly when they are involved.     Denies receiving documents regularly. Staff always threaten you. Takes away people's benefit with no justification. These people are 100 times worse than post office. Please stop these people before it's too late. Several people I know have committed suicide because of these vile people.

    Almost every new claim has resulted in a Tribunal win for me (PIP). Thankfully I'm not in the not in the situation to need to consider UC.

    I'm not entirely sure HOW decision makers think this is going to save them money? The question to ask is 'who's going to profit from this'? 

      It won't be you or me!

    I see a move away from using in main banks. Confuses the shI* out of DWP if your not with a regular bank as it is. 
    Of course the DWP will rise on that to say its cos of fraud.
     How much is it going to COST the DWP/Government to action this is something we should be getting reporters to should from the rooftops!.
     (more than before).  So its a vote winning proposal (for the hard right holding the cash)  just before the election (2nd May I believe, if the Youtube 'be register to vote/you need ID adverts are accurate)

    Calling them is not something I can cope with as after lengthy waits its common to be cut off and you have to start agIn! So my daughter generally deal with them for me and we havent had terrible experiences dealing with them tbh, apart from my first PIP assessment from DLA a d they tried to drop it but I got it back on mandatory reconsideration. 
    I do not think they should be above the law and be able to fine the most vulnerable in our community with no checks and balances, I don't trust them AT ALL. 
    I still think people with Mental health issues or brain injuries have a hard time getting mobility points for PIP which is outrageous, i should get enough points for both but they never give me them for brain damage and inability to plan routes etc

    I had 2 strokes, numerous collapses one of them in a DWP pip assessment. I needed a new knew. Had a pacemaker  fitted and I  have chronic kidney disease due to waiting for a prostate operation. I had an assessment  for ESA.  With a physiotherapist.  Low and behold I was deemed fit to work. 3 years later I finally got pip and ESA. I had 2 tribunals and 1 upper tribunal. DWP  couldn't  care less about you. All they want to do is get money back for the government.

    I would like to know if there is a way for us to stop this bill going through Parliament?  Is there any way we can prevent this from happening - should I be stating my concerns to my local MP?  What else can be done to stop the DWP from being given powers to spy on us?  This must be unlawful?  A breach of our human rights?

    It’s a disgrace so Dwp if don’t like you they can arrest and give a hefty fine it’s open to them abusing their powers. Judge and executioner that’s how it will be done.
