Statutory Sick Pay (SSP) and the sick pay you are entitled to are separate things, you will need to check with your HR department about how the two are combined in the monies you are receiving whilst being of sick. For example, SSP could be included as part of the full pay you have been receiving and therefore may be nearing it's end, conversely it may not apply until you have exhausted all of your half pay an therefore has not started to be paid.

Making a claim for ESA is only concerned with whether you have exhausted your SSP, in principle, it does not matter that you are continuing to receive pay as part of your contract of employment.

I have an appointment with my union to sort out issues at work so hopefully things will move forward from there.

An ESA claim made in 2015 will use the Tax Years 2012-13 and 2013-14 so you need to ensure that you paid National Insurance each week/month during this time. You can contact HMRC for a statement of your contributions.

Thanks Gordon,

I think it should be okay but I contacted the HMRC for a statement just in case.

I've seen my union member and I'm working with her at the moment about the discrimination element and she thinks I have a case. However, I've received a letter from my work this morning offering all staff voluntary redundancy and I was wondering, if i chose to take this, would it affect a claim for ESA? Is it better to wait until they have to let me go?

Hi J,

Taking redundancy, and receiving any lump sum as a result of this should not have any adverse effect on claiming ESA, if you have enough NI Contributions to claim Contribution Based (CB) ESA.

CB ESA is none means tested.

With regards to if and when you should take redundancy, you would need to liaise with your Union Rep regarding that.
