ESA/PIP was created by Jane 235
Hi I am new to this website I would appreciate any advice I have currently been On esa support group but had to go for a medical and I have had a phone call to day to say I am no longer entitied to it and also my claim for PIP has been rejected.
Any advice were to go know please?
A bit of back ground on me I had a gallbladder operation in June last year I developed a infection and ended up in hospital with sepsis I was then left with chronic diarrhea which is awful leaving the house is very stressful and due to bowel urgency and frequency can all so be very embarrising and distressing. When I came out of hospital I just never felt well at all was so tired I couldn't get up some days no energy in constant pain had poor consideration short term memory problems I was always at the doctors were eventually I was diagnosed with ME (chronic fatigue) syndrom every day is a struggle but the ESA/PIP department seem to dismiss this. Any advice how I should tackle the reconsideration thanks

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ

My full name is showing, how can I stop it?

You should have a Statement of Reasons from the Decision Makers on each of your claims which will give you a high level explanation of why your assessments has failed, this would be a good place to start.

Have a read of our Claim guides with the relevant letter to make sure that you understand the criteria that you need to meet for an award. Both PIP and ESA have criteria with multiple elements, all of the elements need to be met in order for you to score points.

ESA

PIP

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. For PIP it is a PA4 and for ESA it will be an ESA85. Once you have the assessment report you will have a better understanding of how the DWP Decision Makers has come to their conclusions and will then be able to argue against them.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claims, have a look at our ESA and PIP MR & Appeal guides for details of the process and template letters that you can use to make the request with.

When you have a better idea of the issues with your claims, come back to the forum by replying to this post and we will do our best to help.

Basically for pip they scored me zero on everything as the health care person had no knowledge of ME /CFS so has basically dismissed it. On my employment support they have acknowledge I wouldn't be able to carry out a full time job but there would be some work I could so. I just don't know were to start when asking for a reconsideration x

Hi Jane.

You need to read through the guides Gordon gave you links to.

You need to ring the numbers on the letters you received and request a Mandatory Reconsideration. You should then follow up the phone call with a written request in case they forget your phone call.

The decision notification will score you for each descriptor and give the reason for the score.
You need to look at each score and decide where you fit on the point scale and why. Then you challenge the score you got by going back over your evidence that supports what you think you should score. If you don't have letters from your GP and consultant(s)/specialist(s) you need to get them to specifically address the descriptors and where they think you fit on the scale.
I hope you have a sympathetic GP who will be happy to go through this with you. You may want to make an extended appointment. You can also request access to your medical file and get copies of letters etc with diagnoses and treatments or effects in them to support you. It won't really do to just say the HCA didn't know anything about my conditions so basically dismissed it.

Lastly do you have the support of a partner, carer or other family member. They can make a statement and come with you to the appeal if the Mandatory Reconsideration doesn't produce a favourable outcome.
Please come back if you need any more help.
