Do you mean that he is now in the WRAG or was he found Fit for Work? Is anybody challenging the Decision that took him out of the SG?

He has to go for an assessment for ESA on Tuesday and I will go with him. I hope they have the copies of a letter both his GP and also the sleep apnoea specialist both wrote for him which we did send for the tribunal, but I will take copies anyway
They didn't say he was actually fit for work ..or anything ...
I did phone the DWP yesterday and asked what was happening now that the tribunal found in his favour ...I was told they had just received his answers to the four questions, which he sent back immediately though they said they had just received them that day

Both you and the DWP have a right to challenge the Tribunal's Decision, but this cannot be done just because one party disagrees with it, a challenge can only be made on the basis of an Error of Law .

In the vast majority of cases there is no discernible Error and the DWP take no further action, it's part of the 5-8 weeks that we advise it will take before the result is processed.

Thanks Gordon for all your help and advice ..I actually cancelled my operation on Friday as I am going to the ESA assessment with David on Tuesday, and I would have been on very high painkillers and not at my sharpest ....no problem I can arrange it later

Went to the ESA appointment with David ...very nice helpfull person ...she said although he is/or was in the support group, chances are the person who makes the decision will put him in a lower group, though not required to go for work ....but she said this seems to be happening a lot and we could go to tribunal on that and was almost certain they would put him in the support group as it has been happening a lot ! So looking yet again at a tribunal which is ust making David worse ...
I have just phoned again the DWP as still no money ! He had the PIP assessment in November, where they turned him down, so long time with no money, and both me and his mother in law are almost skint helping them out
