Dear Gordon,
Terribly sorry to bother you but desperate for your help and advice concerning the fact that I have a date for my ESA Tribunal Hearing on 21 July next week at 1:30 pm And honestly I am dreading it I cant concentrate on anything else I have been physically sick and I am panicking and can not sleep at all as well as the other medical problems I have to put up with.
The thing is its also causing my husband stress and concern and he is also unwell.
I do not know if I can handle it if I loose the tribunal hearing If I am not successful I am sure we will also loose our house as we would not be able to pay the mortgage, and the fact that my benefit has already been cut and reduced since they stopped my esa following the medical I had in March we are already behind in our mortgage as we cannot afford to pay the full amount they ask at the moment even though the majority of my benefit goes on our mortgage.
, I have put in further medical letters and appointments as well as several recent drs letters to the tribunal dept as well as the help from the cab whom have also been trying to support me but even with further information they have received ,I have still had a letter from the decision maker stating that they have not changed there decision.
Which means I have to go to the tribunal hearing, but with just myself and husband as the cab representative has said they cannot assist me due to staff problems on the day.
I last went to a tribunal hearing for dla in 2004 and was successful But I really have a bad feeling about this next week.
Any advice would be greatly appreciated and I dont know what I should wear.
Kindest Regards
Luckydoll

OK the first thing to say is don't assume that you are going to lose, you say you won your last Tribunal so you know that it can be done. The panel will be looking at your claim from scratch and they will look at your evidence with unbiased eyes unlike the Decision Maker.

I'm afraid it won't be easy and you will have to deal with their questions, but just take a moment before you answer to make sure that you understand what is being asked, remember they are not trying to trick you, so give honest answers to questions being asked, don't look for a hidden meaning.

Focus on the goal, getting the award you think you deserve rather than the journey.

Is your husband going to be with you, he can provide testimony about your problems?

Remember to score points you need to show that you meet the criteria, so make sure you understand what that criteria are, but also you must be able to do it reliably and on the majority of days, so if you can't do this then make sure you explain this to the panel.

Best of luck

Gordon

Hi Carol,

Best of luck with your appeal hearing, and try and get a good nights sleep if you can.
