Hi everyone,

I was wondering if I could have a little advice on the MR process please. I have ME, I received DLA for many years before successfully transferring to PIP back in 2015. I was awarded 27 points for daily living and 22 for mobility. I needed to reapply back in September, only had my home assessment carried out in May and have just had the decision. They have now decided to award me 0 for everything. We have a copy of the report and both the Health Professional and case manager have disregarded the GP letter and the letter from my specialist. They've gone against everything that we've told them both in my application and at the F2F.

In the past my Father has dealt with my claims for me due to my condition, however he passed away last year and I am now reliant on my Mum to help me. We've been using the guides, both for my application, and the MR process but I was wondering if there are any tips you can give? We've been through the report and picked out all the incorrect information, but there is a lot and also information about the manner of the HP. Im obtaining another letter from my GP, my osteopath, but unfortunately my ME specialist cannot provide a report about me as their trust policy doesn't allow it unless its requested directly from the DWP. Is it necessary to use the online form, or can I do the MR in just a written document on the computer? Im obviously getting proof of postage as I keep records of everything.

You can make your MR request in a letter, there is an example in the MR & Appeal submissions document in the PIP area.

Even though you used our guides to complete the form, I assume it was the shorter AR1 review form, you also need to consider whether you have properly explained your problems in your claim form, is it possible that you have misunderstood the Descriptors, described your problems in terms that do not match the Descriptors or failed to make appropriate use of the reliability criteria or the need for your limitations to be present on the majority of days to be considered?

Hi Gordon,

Thank you for your reply. No it wasn't the shorter review form, I was sent out the longer more in-depth form. Due to my condition not changing, in fact getting worst, I made sure that I used my previous submitted claims as a guide as well as cross referencing with the Benefits and work guide so to make sure that I covered everything that was necessary to match the descriptors.

Will also using the sample written submissions in the appeal submission guide to outline the inaccuracies of the report and decision be sufficient?

Hi again,

I've written my mandatory reconsideration, going through the descriptors and noting under each where the decision and report both have inaccuracies and backing it up with the evidence and what score I feel I should have been given (like in the B&W guide).

I have also obtained another doctors letter, a new prescription, a letter from my osteopath and hopefully a care plan from my ME specialist to include with the MR.

When I received my decision I immediately applied to my council for a blue badge which today I have received an email confirming that they have approved my need for it and are issuing me with one. Would this be beneficial to add in as evidence to the MR too?

Yes, I would include the information, does it say why you are receiving the Badge, if not, can you obtain this information from your Local Authority.

Hi Amy,

Sorry to hear about your home assessment. You say they have disregarded your GP and specialist letters? They really cannot do that ; that is doubting qualified people who understand your problems much more than they do.

These letters are; or can be considered to be legal documents in my opinion.

Could it be that they caually overlooked your letters? I would get new letters and send them along with the ones you already have and point this out to them.
