I'm 64. Was on a lifetime award of DLA higher rate care, lower rate mobility. I had an assessment in September . It was awful. It was in another town, and would have been 2 half hours on public transport, three buses. I got 7 days notice and refused a home visit.
Son drove me there for 9 am and it took us an hour in the rush hour traffic. I have long term brain injury affecting cognitive functions. Tumour twenty years ago now recurred but just monitored. I have partial epileptic absence seizures daily and poor mental health.PIP Decision awards mobility on grounds I need someone on unfamiliar journeys with seemingly a car tax allowance, but no daily living, I scored 4 points. it's to be reviewed in 10 years. I'm not under the 6 month rule, but not likely to last ten years.
The references to the assessors report says that I presented perfectly ok, not anxious, no problems with finances, speaking, I can use a microwave, mental health was fine. etc.
I was accompanied by my adult son. The assessor refused to allow him to speak as he was not a DWP appointee, and said that if I wanted someone with me I had to have them as a legal appointee, She shouted at me when I started crying, She kept shouting " I'm not a monster, I'm not like these other assessors"." It was surreal. She Insisted he left the room after about 15 minutes, and then demanded to know my suicide specifics and laughed at me about a failed sui attempt. I broke down then, and she brought him back in and ignored anything he said to support my answers. Finally, she appears to have said I refused a balance test, which is untrue. There's more but you get the gist I'm sure. I ended up in A and E on getting the decision letter. I saw my GP as an emergency with chest pains and she called an ambulance to the surgery.. Now on propanalol and had an emergency MH assessment Saturday.. So health is much worse. Ironically, I'll probably have medical letters to support this soon.
Husband had an underlying right to Carers allowance, but gets no money as on State Pension
He had a letter to say this underlying right has now been withdrawn.
The decision letter is dated 23rd October. I got it on the 3Oth October. I rang DWP same day and asked for a copy of the assessors report, details on how to complain about the assessor. and asked for a form and information as to putting in a MR. The person said it was not up to her to agree to provide the assessors report, it was up to "a higher authority," but would pass the request on. Looking in on here at the time, I followed up my phone request by special delivery letter the same day asking for a copy of the assessors report. ( Then we went to GP appointment as so unwell by then)
A few days ago, I got a DWP text telling me that my MR had been received and it would take ten weeks. I haven't submitted it yet! Still waiting for the Assessors report and form and nothing sent to me.
I'm in ESA support, had a home assessment in August by a GP who understood brain injuries. I spent an hour and 15 on hold trying to get a copy of that, and gave up.
Not sure what to do now, and the CAB is ten miles away and two buses. I'm out in the sticks
1. Do I put in an MR without seeing the assessors report as panicking they are just reviewing based on my letter asking for forms and AR? How do I get the assessor report?
2. Do I wait a couple of weeks to get letters from my GP and MH services saying my health is deteriorated and ask for a supersession instead?
I'm aware they could review and award me nothing, at all, but so distressed at the assessor's seeming behaviour and what seems to have been said. ( She was a physiotherapist commenting on what is mainly neurological stuff. Son is away, husband in poor health so on my own here.

I'm appalled at what I have just read and sorry you had this experience.
1. You can ring for your PIP assessor's report. The person was talking complete rubbish - you do not need 'special permission'. It is an absolute right of a claimant to have it. So if you have the energy - ring again and ask for it. Follow up that request with a letter in writing.
2. You also need to ring up and query the letter you have received about an MR and tell them you have not submitted any information. You only have a month to do this so unfortunately, you will need to be quick - but because you have been sent out an incorrect letter, they may extend the time. Follow up with a letter confirming what has been said.
3. It is up to you whether you have the energy to complain. But having an assessor laughing about suicide is unacceptable by any standards. You can complain here

Sorry to post again. Was reading a few other posts.
If I disagree with the decision letter and say why regarding the asessessor's behaviour does this get referred by DM back to the same assessor to comment?
Not sure if I can mentally cope with this same assessor.

If you are putting in a Mandatory Reconsideration - you can talk about the assessor, but the most important thing is to focus on where you thought you should have scored points and you didn't. You can always say that you thought the assessor was unprofessional, but it will make no difference to the score. What you need to do is contradict assumptions, mistakes etc against the PIP criteria. This is hard to do when you haven't had the detail. The Mandatory reconsideration will be looked at by a new person and you will have no contact with the assessor.
If you want to make a complaint against your assessor - this is dealt with separately from your actual claim and again, you will not have any contact with them.

Thanks BIS that is very helpful. I'm sorry it took me a while to reply as I have therapy Monday morning and grand kids arrived this afternoon so only now got a bit of quiet.

Yes I will save the rant for a separate complaint, thanks for the link, and keep it to where I should have scored points. I will say where she was unprofessional where relevant, eg refusing to let son speak and clarify knowing I had a brain injury and re the suicide bit, but I'll stick to the criteria then.
It's a relief to know that the same assessor won't be involved in it again. I'm not holding out great hope re an MR but will take it to a tribunal if needs be.
I still have not had a copy of the assessors report, I will ring again in the morning. It looks like I will be late by a few days returning it, as I've been waiting to see what she said, so replying to the MR based only on the decision letter. I have evidence that I was in A and E and then unwell so will include that.
Interesting that you say I have an absolute right to the assessors report. I wasn't sure. I'll come back and post here what happens regards that at some point just because these threads are so helpful for others looking in.

Update. I rang the PIP line this morning.
The assessor report had NOT been sent out. I don't think they intended to send it. The person said:
1. The call handler who spoke to me the first time, "perhaps", did not have the authority to send it out. That is why she referred to a higher authority. He DID have the authority to send it. and would authorise that now.
2. The first DWP call handler, should have explained to me that:" you do not need a special form to fill in. Just a letter will do asking for an MR is fine, and if you have any other information to be considered, just put it with that.".
3. He failed to mention that there is, in fact, a DWP form and booklet which goes with it and he did not agree to send one when I asked, and just said "it's ok, just send in anything else"..
4. They had taken my letter requesting the assessment report and an MR form as the actual MR request. I said that was not my MR, just a request for the assessor report and a form to submit an MR, following up on the first telephone conversation. He told me not to worry. It was logged on the system as an MR request, so if I want to send anything else in, it will be scanned when received and put in with that. The waiting time now is ten weeks " so you have a while yet to get information to us". I asked when my time was up to submit an MR, and he repeated that it was taking ten weeks, just to send anything else in.
So I will get on today with writing a MR using the B and W advice booklets here.
The CAB in next town do an email service and are going to ring me again regarding the assessor
I will definitely be complaining and if I can find the part of the site here where people can write about the assessment places I will fill that in also.
